Joint guarantee contract
The creditor x x x is referred to as Party A, and the guarantor x x x is referred to as Party B. For the future debt guarantee, this contract is entered into by both parties as follows:
Article 1 Party B has deducted the contract between the main debtor x xx and Party A on xxxx x x day, and the main debtor has overdrawn the loan to Party A with the principal amount of RMB xx, and Party B shall voluntarily meet the requirements of Party A. The responsibility with the main debtor is guaranteed.
Article 2 Party B shall guarantee the settlement of the debts of the main debtor in the future to open the maximum amount of the bill, and the interest-delay liquidated damages shall be implemented. And all damages for the failure to perform the debt.
Article 3 If Party A fails to obtain the overdraft loan, the Party shall be responsible for the excess if it has not agreed by Party B and the main debtor exceeds the limit and limit of the first article.
Article 4 If Party A agrees that the main debtor will first abandon the mortgage or cancel part or all of it, Party B’s joint guarantee obligation shall not be changed accordingly, and shall still be responsible for no excuses for security interest. Changed midway and claimed to waive its responsibility.
Article 5 If the main debtor does not include the performance of the debt, the amount of the non-guaranteed object shall be determined. After Party B has notified Party A, Party B shall immediately dispose of the debts borne by the principal debtor and will be willing to abandon the right of first-instance.
Article 6 Party B's guarantee debt performance place is agreed to be the location of Party A.
Article 7 When Party B fails to perform its duties in accordance with the contract, Party B shall have jurisdiction over Party A's designation, and Party B shall have no objection. Party B's litigation costs in the preceding paragraph should not be pushed back by me.
Article 8 Party B agrees that Party A may transfer part or all of all the debts of the main debtor and its security interests to others.
This contract is made in two copies, and each party holds a copy.
