First, the labor contract period

Third, labor protection and working conditions

Article 4 Party A must implement the working hour system prescribed by the State for the working schedule of Party B. Party A may arrange for Party B to work overtime after the consent of Party B, subject to the consent of Party B, but it shall not violate the relevant provisions of the State, and shall reasonably arrange for employees to make up their compensation or pay overtime according to the relevant provisions of the Labor Law and extend the salary of working hours.

Article 5 Party A shall conduct Party B safety education on Party B before Party B enters the construction site. Party A shall conduct pre-job training for Party B who has obtained the operation certificate for special types of work such as electrician, welder or ascending operation before proceeding to work.

Article 6 Party A shall provide Party B with necessary safety protection measures and issue necessary labor protection articles in accordance with the requirements of production posts and in accordance with the relevant provisions on national labor safety and hygiene.

Article 7 Party A shall establish a safe production system in accordance with the relevant laws and regulations of the State; Party B shall strictly abide by Party A's labor safety system, strictly prohibit illegal operations, prevent accidents during the labor process, and reduce occupational hazards.

Fourth, wage insurance benefits

Article 8 Party B's salary during the probation period is daily, and the salary is calculated as daily yuan after the trial period expires;

The wages agreed by both parties shall not be lower than the minimum wage in the administrative area of ​​the construction site.

Party A shall calculate the salary of Party B by the date of each month and shall be signed and confirmed by Party B.

Party A shall pay Party B's salary in one lump sum when the labor contract is terminated or released.

If Party A of the contract is a subcontractor, the general contractor shall be responsible for the payment of the default.

Other agreement between Party A and Party B on wage payment

Article 9 Party A shall, in accordance with the regulations, handle social insurance for Party B and pay social insurance fees in full according to regulations. After the labor contracts of both parties are lifted, the social insurance procedures shall be transferred in accordance with relevant regulations. Party B is injured due to work, and its treatment is implemented in accordance with the relevant provisions of the State and local people's governments.

5. Change, termination, termination, renewal of labor discipline and labor contract

Article 10 Party B shall strictly abide by Party A's various systems, labor disciplines and safety technical operating procedures.

Article 11 If Party B has one of the following circumstances, Party A may cancel this contract:

During the trial period, it is proved that it does not meet the conditions of employment;

There are violations of laws and disciplines such as fighting, stealing, and gambling;

Serious dereliction of duty, malpractice, causing significant damage to Party A;

Seriously violating Party A's construction site safety management regulations and Party A's labor discipline;

Being investigated for criminal responsibility according to law.

Article 12 If one of the following circumstances occurs, Party B may terminate this contract;

During the trial period;

Party A forces labor by means of violence, threats, imprisonment, or illegal restrictions on personal freedom;

Party A cannot provide safe working conditions or pay labor remuneration in accordance with the provisions of this contract.

Article 13 To change, terminate, terminate or renew this contract, the other party shall notify the other party in writing before the prescribed time limit, and the contract may not be altered, terminated or terminated without authorization.

6. Liability for breach of contract, handling of labor disputes and other

Article 14 When Party A and Party B terminate the labor contract, Party B shall issue a certificate of termination or termination of the labor contract to Party B.

Party A shall terminate the labor contract of Party B and comply with the provisions of the Ministry of Labor [1994] No. 481 file, and shall pay economic compensation.

If Party A and Party B illegally terminate the labor contract, they shall give the other party compensation according to the file No. 223 [1995] issued by the Ministry of Labor.

Article 15 If a dispute arises between the two parties in the performance of this contract, it shall, within 60 days from the date of the occurrence of the labor dispute, apply to the labor arbitration committee with jurisdiction at the place where the project is located for arbitration. Those who are dissatisfied with the arbitral award may file a suit in a people's court 15 days from the date of the award.

Article 16 The rules and regulations formulated by Party A and other special agreements shall be the subsidiary files of this labor contract and have the same legal effect as the labor contract.

Article 17 If the matters not covered in this contract are contrary to the relevant provisions of the State or Sichuan Province, they shall be implemented in accordance with relevant regulations.

Article 18 This contract is in quadruplicate. Each Party A and Party B shall hold one copy, one for the labor department of the locality where the project is located, and one for the construction site of the work of Party B for future reference. This contract shall become effective on the date of signature by both parties.

Instructions for use

1. This contract is used by Sichuan construction enterprises and laborers to sign labor contracts.

2. When a construction enterprise and a migrant worker sign a labor contract, the content agreed by both parties shall be filled in the corresponding space after consultation.
