Part 1: Training Agreement

First, the purpose

In order to clarify the rights and obligations of both Party A and Party B, the two parties have signed the following terms for mutual compliance.

3.3.2 The training fee is above RMB ___ yuan, below ___ yuan, Party B must serve Party A after the training period ends ___ years or more, ___ years below.

3.3.3 If the training fee is above RMB ___ yuan, Party B must serve Party A for more than __ years after the training period ends.

3.4 If Party B terminates the labor contract without the consent of Party A or leaves the company early, Party B shall pay Party A all the training expenses incurred.

3.5 The original qualification certificate obtained after Party B's training is passed to Party A for unified custody, until Party B voluntarily resigns after the expiration of Party B's service.

3.6 This Agreement is made in two copies. Each Party A and Party B shall hold one copy and shall enter into force on the date of signature or seal by both parties.

Part 2: Training Agreement

Both Party A and Party B adhere to the principle of good faith and fairness, and negotiate with each other to reach the following agreement on Party A's appointment of Party B _______________________:

1. Party A shall appoint Party B to ______________ from _____________________________________________________________________________________________________________________________________________________________________________________________________________________________

2. Party B ___________ The expenses incurred during the training period shall be reported in accordance with the personnel management system and financial operation procedures.

3. Party B currently serves in the _______ company ___ department and serves as _______. During the above period, Party B shall continue to work in the arrangements arranged by Party A. When Party B is unable to perform the labor contract due to force majeure, Party B promises not to unilaterally propose to terminate the labor contract.

4. Party B requests to terminate the labor contract in advance. Upon agreement of Party A, the labor contract will be terminated, but Party B shall compensate Party A for the payment of Party B's __________ training exchange.

The amount of compensation is calculated according to the following formula:

Amount of compensation = total cost due to training * unfilled labor contract period / extended labor contract period

5. Party A does not agree that Party B shall terminate the labor contract in advance. If Party B insists on dismissal or arbitrarily resigns or is dismissed by the company for violation of law or discipline, in addition to calculating the compensation according to the above formula, it shall also pay liquidated damages. Liquidated damages are calculated according to the following formula:

Amount of compensation = total cost due to training * unfilled labor contract period / extended labor contract period

6. Party B shall terminate the liquidated damages/indemnities of the labor contract in advance before Party A handles the termination of the labor contract.

7. Party B shall provide Party A with guarantor ______________, and the guarantor shall issue a letter of guarantee to Party A to ensure Party B's performance of its obligations under this Agreement. In the case of the labor contract, the guarantor shall assume the guarantee responsibility to Party A, and ensure that Party B shall pay compensation or liquidated damages as agreed.

8. This Agreement shall come into effect on the date of signing by both parties and shall terminate upon the expiration of Party B's labor contract.

9. This Agreement is in duplicate and has the same effect. Each Party A and Party B hold one copy.

When Party B terminates the labor contract, the guarantor shall assume the guarantee responsibility to Party A, and ensure that Party B shall pay compensation/default liquidated damage as agreed.
