In principle, the operating enterprise shall apply for the production capacity certification form of the processing enterprise to the foreign trade and economic approval authority where the processing enterprise is registered. After the processing enterprise fills in the production capacity certification of the processing enterprise according to the requirements of the form, the operating enterprise shall submit the foreign trade and economic approval authority for examination and approval. The foreign trade and economic examination and approval authority uses written materials and on-the-spot investigation methods to conduct inspections on processing enterprises. It is strictly forbidden for “three no” enterprises to carry out processing trade and prevent enterprises from carrying out illegal activities such as smuggling in the name of processing trade. After the inspection is passed, the foreign trade and economic examination and approval authority shall affix the special seal for the examination and approval of the processing trade business or the special seal for the examination and approval of the processing trade business of the foreign-invested enterprise on the certificate of production capacity of the processing enterprise.

Conditions for applying for proof of production capacity of processing enterprises

I. Renewal and change process

1. Download the form, fill it in both sides and print it on both sides. Do not fill it in three copies;

2. After completing the form, the enterprise must also log in to the China International Electronic Commerce Center of the Ministry of Commerce), fill in the relevant data into the online database, and send it to the China International Electronic Commerce Center according to the “Submit Key”;

3. The enterprise will report the forms and relevant materials to the foreign trade and economic departments at all levels, and the foreign trade and economic departments at all levels will receive the information and conduct examination and approval in the online database, and issue a new “Production Capacity Certificate” after field inspection according to the specific situation.

Second, the basic information of the enterprise to be submitted for renewal:

1. The approval certificate for the annual review of foreign-invested enterprises, the valid qualification certificate or registration form for foreign trade enterprises, and the business license;

2. The audit report of the previous year of the foreign-invested enterprise;

3. The certificate of tax payment for the previous year of the enterprise;

4. The certificate of receipt and payment of the enterprise in the previous year;

5. If the real estate license of the company's own production plant is a leased factory, a valid lease contract must be submitted;

6. Relevant materials that have been added and changed after the original “Production Capacity Certificate” has been processed, including:

Approval of amendments or supplements to the articles of association;

a tax registration certificate for changes in the enterprise;

The capital verification report after the enterprise newly applied for capital verification;

The enterprise is notified by the customs reclassification rating level;

The company added new product technology level assessment and patent certification.

Third, change considerations

The enterprise "Procedure of Production Capacity" has not expired, but if the enterprise information in the form is changed and affects the use of the "Production Capacity Certificate", it must go through the change of the foreign trade department of the issuing license, and provide relevant files and certificates according to the corresponding changes. The original and photocopy are modified by the issuing department in the online database submitted by the original enterprise, and the enterprise does not need to transmit it online.
