Overview

Birth notarization refers to the activity of the notary office with the right of foreign-related notarization to prove the legal facts of the party according to the law according to the application of the party. Birth notarization requires submission of materials

Note on birth notarization

1. The name of the party in the notarial certificate must be true. If there are special requirements, it must be carefully examined and verified before being proved. The names of the parties are always in simplified form. In the foreign language translation, Chinese Pinyin is to be used. In order to facilitate the use of the notarial certificate by the parties, if there is a valid name, it shall be proved at the same time on the notarial certificate.

2. The date of birth of the party in the notarial certificate is one of the core contents of the notarization certificate. It must be accurate, true, and conclusive. The date of birth is subject to the ID card. If there is no ID card, the certificate of birth registration or birth certificate shall prevail. Without the above-mentioned certificate, the Gregorian calendar shall be used with reference to other certificates. If the notarizing party has otherwise requested, the date of birth of the Lunar calendar may be indicated in brackets.

3. The place of birth of the party in the notarial certificate shall be clear and specific, and the place name shall be written in full. The birth address should be written to the city or county. It can also be written to the township, village or town street according to the requirements of the place of use. If the place name at the time of birth has changed, the full name of the original place name should be stated in the brackets after the current place name.

4. Birth certificate The parent should write the name of the parent. If the parent dies, it should be marked with a bracket. The request does not write the name of the father.

5. If the identity card provided by the party is inconsistent with the date on the overseas certificate, and the proposed change is inconsistent due to the work error of the original issuing authority, the party concerned shall go to the issuing authority to request correction and then give the notarization. If the notary party is lied to report the age at the time of going abroad, it should be notarized according to the true age.

6. If a foreign party has applied for a birth certificate, the notary office has investigated and found no clues, and the party may issue a “notarized documentary certificate”. In countries such as the United States, this notary can be used as secondary evidence.

7. The notary office can only apply for a birth certificate for a Chinese citizen or foreigner born in China. If a person born abroad needs such a certificate, he/she should obtain a birth certificate from the local authorities.
