International labor contract

After the friendly negotiation between PMH and CHC Engineering Company, Party B agreed to provide labor services for Party A's construction of the ZZZ project in the EMS country, and signed the labor contract with Party A for this purpose.

Purpose of contract

The purpose of this contract: Party B shall provide technical workers, engineering and technical personnel and other personnel to Party A in accordance with the terms of this contract, and Party A shall pay compensation to Party B.

In order to ensure the smooth completion of Party A's project, both parties should cooperate with each other and conscientiously implement the contract.

Personnel dispatch

1. Personnel should be dispatched according to the plan agreed by both parties. Party A shall formally notify Party B in writing of the personnel required to be dispatched two months in advance. Party B agrees to submit a list of dispatched personnel to Party A one month before the dispatch, including name, date of birth, type of work, passport number and information required for EMS country to apply for entry.

2. Party B shall be responsible for handling the exit procedures of Party B's personnel and shall bear all expenses related to this. The entry and residence procedures in the EMS country are handled by Party A and bear the costs associated with this.

3. Depending on the needs of the engineering program, dispatch personnel may increase or decrease at any time.

4. If additional personnel are to be dispatched, Party A agrees to submit a dispatch plan to Party B's headquarters two months in advance. Increase the salary of personnel and pay in accordance with the salary standards listed in Attachment 1 of this Agreement. If the new project is added, the salary standard shall be agreed by the representatives of the two parties at the construction site.

5. According to the progress of the project, if the site needs to reduce personnel, it should be implemented by the on-site representatives of both parties.

Preparation fee

Party A agrees to pay Party B the dispatching fee of ____ US dollars per person. The preparation fee shall be transferred to Party B's ____ bank account number while submitting the dispatch plan to Party B.

wage

1. The original salary of the dispatched personnel shall be paid in accordance with the salary scale agreed in the attached file. The salary shall be calculated from the date when the dispatched personnel leave the STU airport of the country where the party is located to the date of leaving the EMS country ____ airport. Party B agrees to take the shortest route as much as possible when scheduling the route and shorten the time.

2. The basic salary of dispatched personnel is detailed in Attached File 1.

3. The basic salary is calculated on a monthly basis. For any day less than one month, the daily wage is 25% of the monthly salary.

4. According to the current economic situation of the EMS countries, the basic salary of dispatched personnel should grow by 15% annually.

Working hours and overtime

1. Party B's working hours are 25 days a month, 6 days a week, 8 hours a day.
2. One day off per week, the specific vacation date can be arranged on the spot by both parties.
3. If the material is not properly constructed due to shortage of materials and climatic conditions, the contents of the work may be temporarily adjusted through negotiation between the two parties. If the work is stopped due to the above and other reasons, Party A agrees to pay the wages of Party B.
4. If the work requires and with the consent of both parties, Party B's personnel can work overtime. Party A shall pay overtime wages according to the following criteria;

The usual overtime pay is 125% of the basic salary;
Usually work overtime at night and overtime on holidays, the salary is 150% of the basic salary;
The holiday overtime pay is 200% of the basic salary;
The overtime pay calculation method is as follows:

The above overtime pay and basic salary are paid at the same time.

a meal

1. Party A agrees to provide Party B with a full set of kitchen utensils and refrigerating equipment, and Party B shall handle one meal by itself.
2. Party A agrees to pay Party B a meal fee of ____ USD per person per day for use.
3. The water for the canteen, the electricity and fuel, and the purchase of living materials shall be provided by Party A and paid.

Holidays and vacations

1. All Party B personnel are entitled to the statutory holidays of the EMS government.
2. All Party B personnel shall enjoy 20 days of return home visits after working for 11 months and 10 days. The return ticket from ESM country ____ airport to STU airport shall be paid by Party A. Should arrange the most possible

3. If on-site construction requires Party B's personnel to delay returning to China, Party B agrees to convince its personnel to postpone the leave, and Party A agrees to pay appropriate compensation in order to compensate Party B's losses.
4. Remuneration for compensation for the above losses may be agreed upon by the on-site representatives of both parties based on the circumstances. However, this compensation should not be less than the one-way fare amount between the EMS country ____ airport and STU airport.
5. If the staff of Party B has been working for more than half a year due to unfortunate circumstances of their families, they may enjoy the family leave in advance if they are agreed by the on-site representatives. If the relevant personnel have already enjoyed returning to China, their round-trip travel expenses shall be borne by Party B. Party A shall not pay wages for this leave.

Travel and transportation

1. Party A shall bear the necessary accommodation and accommodation expenses from the STU airport to the project site and the necessary accommodation and accommodation expenses, but Party B shall endeavor to reduce the expenses of this additional fee. Party A agrees to pay Party B personnel to enter the EMS country. Entry fee.

2. Party A is responsible for providing Party B's commuter to and from work, as well as providing work vehicles for on-site representatives, engineers and other management personnel.

3. Party B shall settle with Party A with the ticket or receipt.

Tax

All taxes paid by Party B personnel in ____ shall be paid by Party B; all taxes paid by Party B personnel in the EMS country shall be borne by Party A.

Social insurance

1. The personal insurance of Party B personnel during the validity period of the contract shall be handled by Party B itself. Party A agrees to pay the personal insurance premium of ____ US dollars per month for Party B's dispatched personnel.

2. Party B's personnel have a work-related injury at the construction site. Party A only bears the medical expenses. In the event of a fatal accident, Party B shall bear all expenses, including the burial and pension.

3. If a person from Party B dies due to a work accident or illness, the body is transported back to the country of origin or buried on the spot, and the relics are transported back to their country of origin. All relevant expenses are borne by Party A.

4. If the dispatched person proves that he or she is absent from work for 30 days due to illness or work injury, the basic salary will be paid; between 30 days and 90 days, 60% of the basic salary will be paid. Those who have been over 90 days will not be paid.

Medical

1. When all employees of Party B have a work-related injury or illness in the EMS country, their medical and hospitalization expenses shall be paid by Party A.

2. For the commonly used drugs and utensils used by the on-site medical office, Party B shall submit the purchase plan to Party A. After Party A's consent, Party B shall purchase it in its home country or elsewhere, and the expenses shall be paid by Party A.

3. Party B personnel are equipped with one doctor and one male nurse within 200 persons. When there are more than 200 people, whether to increase the number of medical personnel is determined by the on-site representatives of both sides.

Labor insurance supplies

Party A agrees to pay all the labor protection articles dispatched by Party B, including two sets of work clothes, work shoes, gloves, glasses, helmets and safety belts per person per year.

Payment method

1. In addition to the full payment of the airfare and preparation fees, Party A shall pay Party B's other expenses, which are paid in proportion to 80% of the US dollar and 20% of the EMS national dinars. agree.

2. The vacation pay and the airfare payable to Party B shall be paid at the beginning of the month of the vacation.

3. Party B's on-site accounting shall prepare the salary and other expenses of the dispatched personnel at the end of each month, including basic salary, overtime pay, and a food expenses. After Party A's review and approval, it shall be paid before the 10th of the following month. Among them, 80% of the US dollar is transferred by Party A to ____ bank ____ account, and bank remittance is borne by Party A. 20% of the EMS country dinars are paid on site.

4. The exchange rate between the US dollar and the EMS country dinars is converted according to the middle price of the sale and purchase announced by the EMS government bank on the payment date.

5. After Party B dispatches personnel to the scene, Party A agrees to advance the food expenses for each person for one month. If other expenses are required, it will be settled by the on-site representatives of both parties.

Housing and public housing

1. Party A will provide the housing of Party B personnel free of charge according to the following criteria:

One representative per person, engineer and director;
Assistant engineer, technician, doctor, accountant, translator and other management personnel;
The other workers are about 4 square meters each, but each has no more than 12 people.

2. The house includes air conditioning and sanitary equipment, furniture and bedding.

3. Party A agrees to provide office equipment, washing equipment and supplies used by Party B's administrative staff.

Personnel replacement

1. Party B is responsible for dispatching qualified and skilled personnel to work in the EMS country. If Party A believes that the dispatched personnel are not qualified for the work, Party B shall be responsible for the replacement after the consent of the on-site representatives. The expenses incurred shall be the responsibility of Party B. .

2. Party B personnel must abide by the laws and regulations of the EMS government and respect local customs and habits. If it is necessary to return to the country in violation of local laws and customs and customs, Party B shall be responsible for the return of the ticket after the negotiation between the two parties. The ticket fee shall be borne by Party B. If additional personnel are required to be substituted, Party B shall be responsible for the travel expenses from STU Airport to the site.

3. Party B’s personnel, due to illness and public injury, have proved that they cannot continue to work as a doctor appointed by both parties. They should return to their country of origin and their travel expenses should be borne by Party A. If the medical condition is unqualified, it is confirmed by the doctors of both sides that it is due to the negligence of Party B’s medical examination and must be returned to the country. The travel expenses of Party B shall be borne by Party B.

Irresistible

1. Party A shall be responsible for returning Party B personnel to the country due to irresistible accidents such as natural disasters, wars, political incidents and other work that cannot be continued.

2. In the event of the above, Party A's personnel will not withdraw, and Party B's personnel will not withdraw, but Party A shall pay the wages of Party B's dispatched personnel.

Dispute and arbitration

1. In the execution of the contract, if there is a dispute between the two parties, the two sides agree to resolve it through friendly negotiation. If the negotiation is invalid, the arbitral institution of the defendant may be submitted to rule:

Chef service contract

The Washington XX Restaurant and the China XX International Economic and Technical Cooperation Company conducted friendly consultations and reached a consensus on the employment of Party B's cooking technicians in Party A. The contract was signed in Changsha, Hunan Province, China. The provisions are as follows:

First, the service project

1. Party B shall employ Party A to dispatch eight culinary technicians to the Washington, DC, USA for technical services. The responsibilities are: in accordance with the requirements of Party A, prepare the × vegetable recipe, the main processing × the finishing of the dish, the finished product;

2. Party B shall supply Party A with raw materials, auxiliary materials and seasonings that reflect the needs of X dishes, and the expenses shall be borne by Party A. The varieties, quantities and prices of raw and auxiliary materials and seasonings shall be determined by the two parties.

Second, the treatment and expenses

Party B's applicants shall enjoy the following treatment during their work in Party A:

1. Party A shall bear the expenses for meals, accommodation, transportation, medical care, insurance and all taxes of Party B personnel, and provide the same labor insurance products for local employees in the same industry;

2. Applicants' housing should be equipped with air conditioning and winter warming equipment, as well as furniture, bedding and other living utensils;

3. Party B personnel enjoy the seven-day holiday in China and the salary is paid.

4. All applicants of Party B will enjoy two weeks of paid leave after working for 12 months on site. The round-trip ticket will be borne by Party A.

5. If Party B needs to be healed or rested due to illness or work accident, it shall be handled in accordance with the relevant regulations of the local government. In the event of disability or death, the pension is also handled in accordance with the relevant regulations of the local government. Party A shall assist Party B in handling the aftermath.

Party A shall pay Party B the following fees:

1. When Party B's applicants first work in the United States, Party A shall pay Party B a preparation fee of US$500 per person.

2. The monthly net salary paid by Party A to Party B's eight applicants is XX×USD; for every one year of work, from the thirteenth month, each person will receive a monthly salary increase of 10%.

3. Party B staff work six days a week and work eight hours a day. The specific schedule will be handled according to Party A's schedule. If it is necessary to extend working hours or holidays, public holidays need to work overtime, Party A should pay overtime. Overtime pay is calculated in hours and overtime pay is 150% of the hourly wage.

The hourly wage is calculated according to the following formula:

Third, the responsibility of both parties

Party A’s responsibility

1. Responsible for the round-trip travel expenses of the applicants from Party B to the workplace, and within 30 days before the departure of the staff of Party B, the ticket and preparation fee will be remitted to the foreign exchange account of China International Economic and Technical Cooperation Corporation of Bank of China × × Branch, to the Chinese side After the arrival of the personnel, they shall be written off to Party A;

2. Responsible for handling the visas, residence permits, work permits and other formalities required for Party B's candidates to enter Party A's territory, and responsible for their expenses;

3. Provide Party B with convenient work, respect their living habits, protect their personal safety, and return to China on time after the expiration of the contract.

Party B’s responsibility

1. Selection of technically competent and healthy cooking technicians;
2. Provide Party A with written information on the name, curriculum vitae, and health checklist of the person to be hired;
3. Responsible for handling the relevant exit procedures for the recruited personnel in China and paying their expenses;
4. Responsible for paying all taxes payable by the starting personnel in China;
5. Education shall appoint personnel to abide by Party A’s domestic laws and regulations, respect local customs and customs; and not participate in trade union organizations and all political activities in the host country;
6. If Party B’s personnel violates Party A’s domestic laws and the local government decides to leave the country, the return travel expenses shall be borne by Party B;
7. Party B personnel shall abide by Party A's store rules and comply with the working hours service arranged by Party A. If there is no reason, the absentee will be deducted according to the working hours. If the employee continues to commit the crime and has repeatedly refused to do so, Party A has the right to propose dismissal to Party B. Travel expenses shall be borne by Party B;

Fourth, payment

1. The preparation fee, overtime pay and wages paid by Party A to Party B shall be paid in US dollars;
2. On the fifth day of each month, the settlement date of the previous month's salary and overtime pay, Party A shall, within seven days after receiving the notice of Party B's settlement list, remit the previous month's salary and overtime pay to the Bank of China ×× Branch China International Economic and Technical Cooperation Corporation. account;
3. The fees required for the above remittances shall be borne by Party A;
4. If Party A fails to pay on time, one day's due date will be fined 0.5% of the total payable wages and overtime pay. Failure to pay for more than 30 days is considered a breach of contract.

V. Replacement and dismissal of candidates

1. After obtaining the consent of Party A, Party B may temporarily recall and replace the individual candidates, and the expenses incurred by Party B shall be borne by Party B;

2. If Party A requests to shorten the working period of individual applicants, it must be submitted three months in advance and with the consent of Party B before it can be implemented. All the expenses incurred by Party A shall be borne by Party A;

3. The applicant has a bad working attitude and Party A can dismiss the employee, but he must notify Party B one month in advance and explain the reason. The travel expenses for returning to China are borne by Party B.

VI. Arbitration

All disputes that occurred during the execution of the contract by both parties shall be settled through friendly negotiation. If the parties fail to reach an agreement, they may submit the arbitration.

7. Entry into force and termination of the contract

1. This contract is effective as of the date of signature by both parties. The contract period is two years. The validity period shall be calculated from the date when the applicant of Party B leaves the country to arrive at the Washington, DC, restaurant in the United States.

2. If any party requests amendments to certain terms of the contract during the validity period of the contract, it must submit a request to the other party in writing, and the parties will sign the supplementary contract. If you need to extend the contract period, you must submit it to the other side three months before the expiration of this contract. After the two parties have agreed on the agreement and complete the contract extension procedure, they can extend it.

3. If one party breaches the contract and causes the interruption of the contract, the party shall be compensated for the total amount of wages of the three parties at the time of compensation for the return of the other party.

4. Matters not covered in this contract will be resolved by friendly negotiation between the two parties.
