After equal and friendly consultations, Party A and Party B signed the following agreements on the export and transportation of air cargo on the day of the month:
Entrusted matter Party A accepts the entrustment of Party B and undertakes the air export transportation business entrusted by Party B. Party B shall designate Party A as its agent to arrange for the delivery of goods, handling export declarations and inspection and quarantine of export commodities.
Party B shall submit the Export Power of Attorney to Party A in writing five working days before the shipment of each shipment.
The "Power of Attorney" shall include but is not limited to the following:
Shipper's name, name, address, contact information;
Consignee name, name, address, contact information;
Notice party name, name, address, contact information;
Flight number, date, port of origin, port of destination;
Product name, number of pieces, weight, volume, declared value;
Standards and payment methods for freight and other charges;
Shipper's signature, stamp, date.
If the power of attorney submitted by Party B is not signed or sealed and lacks some or all of the above contents, Party B shall make corrections according to Party A's requirements, otherwise Party A has the right to refuse to accept the commission.
If Party B entrusts Party A to handle the goods export declaration and export commodity inspection and quarantine, it shall promptly provide Party A with the files and documents required for handling the above matters. Party B shall be responsible for the authenticity, legality and completeness of the files and documents provided by Party B.
If Party B requests to cancel or change the entrusted matters or entrusted contents after issuing a commission to Party A, it shall be in writing and approved by Party A. Party B shall compensate Party A for the additional expenses incurred by Party A.
Receiving the goods If Party A finds that Party B's goods are in poor condition when receiving the goods, Party A has the right to refuse to accept the goods. If Party B cannot improve the goods and their packaging within the time required by Party A, Party A has the right to stop the shipment of goods for Party B. Due to Party A's failure to deliver the goods to the port within the time specified by Party B, Party B has awarded Party A a claim for loss.
Requirements for the goods Party B shall not carry prohibited transportation, restricted transportation and dangerous goods in the goods it consigns. The provisions on the prohibition of transportation, restrictions on the transport of goods and dangerous goods shall be subject to the express provisions of international conventions, relevant national laws and regulations, and trade associations. If Party B misrepresents the name of the goods and encloses the above-mentioned items, Party B shall be liable for the total loss caused by Party A.
Party B shall pay Party A all the transportation and miscellaneous expenses related to the transportation of the goods.
Party B shall pay the corresponding amount to Party A within 30 days after the goods take off.
Any matters relating to this Agreement shall be governed by the laws, regulations and relevant international conventions of the People's Republic of China.
Modifications and additions to the Agreement Modifications and additions to this Agreement shall be in writing and confirmed in writing by both parties. Modifications and additions shall take effect from the date of mutual confirmation by both parties.
This Agreement shall enter into force on the date of the seal of both parties. This Agreement is valid until the date of the year.
This Agreement is signed by fax and has the same legal effect.
