Legal clinic case study summary report
According to the arrangement of the postgraduate training and management office of the school, the XX grade Fashuo class organized a two-month case analysis activity. This activity, the organization of the work is effective, the instructors carefully instructed, the effect is very obvious, the students feel a lot of benefits.
A class of seven students was selected to form a case analysis team. The team members carried out a detailed division of labor: each of the two played the plaintiff, the defendant and the judge, and was responsible for drafting the complaint and the plaintiff's agent; the defense, the defendant's agent; the court judgment.
The activity is divided into three stages: the first stage: the learning method, the two tutors of the usage college guide the students to read the papers, and teach the students how to write the documents; the second stage: the case analysis, the students choose the files, and work separately. Drafting relevant legal documents; the third stage: the examiner examines and analyzes the students. The students pass the electronic documents of the drafted legal documents to the tutor. After carefully reviewing the various legal documents submitted by the students, the instructors convene the students and use multimedia for each legal document. Comments, appreciation of success, pointing out the inadequacies, and suggesting improvements. From the format of the document to the expression of language, from collecting evidence to seeking legal basis, Vice President Zhang Ping has carried out wonderful, refined and classic explanations.
This case analysis activity enabled the students to enhance their business skills and master practical skills. Each student has a sensible experience and a theoretical improvement on how to carry out the marking work, grasp the focus of controversy, and draft legal documents related to civil litigation. However, due to the limited time of this event, the students felt that the practical activities were not deep enough, and many key aspects of the practical activities were not yet mastered. As Vice President Zhang Ping said: After reading and drafting legal documents, after understanding the basic process, the key is to strengthen practical exercises and improve the ability to grasp details in the practice process. Whoever masters the details, whoever has mastered the initiative, can become a master of case handling faster.
Some inspirations from legal clinic activities:
First, the practice link needs to be systematic. It is hoped that similar law analysis activities will be carried out among all students immediately after entering the school, so that the students can master the marking skills in the first semester and have the skills to draft various legal documents. The second semester goes deep into how to grasp the focus of the case, study the evidence and legal basis, and master the offensive and defensive skills. In the third semester, a mock court will be launched to further strengthen students' practical ability in litigation activities.
Second, practical activities need to be standardized. Give full play to the role of the tutor and the tutor of the usage school. The off-campus tutors directly enter the school to carry out teaching activities, and the teaching effect is not consistent with our pre-conceived ideas. If these instructors are responsible for the guidance of student practice activities, the effect may be more obvious. Can the specific method be designed as: New students entering the school, which is divided into practice groups of fifteen to twenty people, each group elects a contact person, responsible for external contact with the tutor, and conducts practical activities for the students. Each external tutor brings a practice group to assign students to conduct specific case analysis based on the content of the first recommendation. The external tutor is responsible for the practical ability of the students.
All the teaching content of the practice link will be included in the students' usual scores.
Third, practical activities need to be popularized. Practical ability should be the greatest employment competitiveness of Fa Shuo. At present, there are very few people who are actually involved in practical activities. Many students will regret or regret when they graduate. The main reason is that students do not know enough about the importance of the practice. To this end, it is necessary to put some pressure on students in this respect, and all law students must be involved in practical activities.
