In order to effectively strengthen the safety production management at the construction site, in accordance with the "Safety Production Law of the People's Republic of China", "Building Law of the People's Republic of China", "Contract Law of the People's Republic of China" and the "Trial Measures for the Division of Responsibility for Production Safety Accidents in Beijing", The two parties signed this letter of responsibility in accordance with the principle of equality and voluntariness. Party A and Party B shall strictly abide by the powers, responsibilities and obligations stipulated in this letter of responsibility to ensure the safe production at the construction site.

1. Party A's rights, responsibilities and obligations:

1. Implementing the national and Beijing regulations and management regulations on construction site safety production and civilized construction, and conducting comprehensive safety production management, supervision and inspection on the construction site and the management regulations of Party A's Safety Manual.

2. Strictly review the qualifications of the personnel of Party B, and do not use non-conforming personnel who do not have the qualification for employment.

3. Ensure safe production conditions at the construction site. The safety protection facilities shall be provided by Party A. Before delivery, both parties shall handle the handover procedures, and Party A shall conduct daily supervision and inspection on Party B in accordance with the relevant safety standards of Beijing.

4. Provide electricity for construction and ensure compliance with safety standards. Responsible for providing construction power supply that meets safety standards. In accordance with the relevant safety power standards, Party B shall supervise and inspect the construction and electrical facilities and equipment of Party B, and find that hidden dangers are instructed to rectify Party B.

5. Supervise and urge Party B's special types of operators to establish files and record them in Party A.

6. Conduct safety production and civilized construction inspection on Party B's construction area, promptly correct Party B's construction personnel's illegal command and illegal operation, and investigate and deal with it according to relevant regulations. A penalty notice shall be issued for the hidden dangers of safety accidents in the construction area of ​​Party B.

7. Provide Party B with the "Elevator Project Emergency Plan".

8. Establish and improve various safety production management systems at the construction site.

9. Provide guidance on Party B's safety production training, use of labor protection supplies, and hazard prediction, and supervise the implementation.

10. Actively provide assistance to the safety production requirements put forward by Party B.

11. Provide fire protection facilities on the construction site.

12. Party B shall provide assistance and rescue services in the event of a production safety accident.

13. Provide assistance to the safe production activities carried out by Party B.

14. Party A and the insurance company shall bear the responsibility for accidents and economic responsibility when Party A’s responsibility causes a production safety accident and causes Party B’s casualties.

15. When Party B's responsibility causes a production safety accident, Party A is obliged to assist the insurance company in dealing with the aftermath.

2. Party B's rights, responsibilities and obligations:

1. Implementing the national and municipal regulations and management systems for construction site safety production, establishing and improving the safety production management system for safety production responsibility, and taking overall responsibility for the safety production management of sub-contracted construction areas.

2. Accept Party A's review of personnel qualifications and provide relevant information. Construction in strict accordance with the scope of construction qualifications, may not undertake construction tasks beyond the scope of qualification. Strictly abide by the "Building Law of the People's Republic of China" and relevant regulations of Beijing, and subcontracting projects may not be subcontracted again.

3. Obey the safety production management of Party A and have the right to refuse Party A's instructions for violating safety production regulations.

4. It is fully responsible for the erection, dismantling, maintenance and transformation of the safety protection facilities delivered by Party A. It must meet the relevant safety standards of Beijing and meet the requirements of Party A for the overall safety protection of the construction site. Before erection, dismantling and transformation, it must report to Party A.

5. Have full management responsibility for the construction electricity used in the jurisdiction. Party B shall equip its own distribution box and cable complying with safety standards to the construction site, and shall have the right to refuse the use of electrical equipment that does not meet the safety standards to pull the power from the line under its jurisdiction.

6. Responsible for safety management and maintenance of mechanical equipment carried and used by itself, and in line with Beijing's relevant safety standards. When using large mechanical equipment, it should be filed with Party A before use.

7. Provide qualified labor protection supplies for the team's operators and conduct education for danger prediction. Safety management shall be carried out for the workers of special types of work to ensure that the workers of special types of work are certified to work, and the files of the special types of workers are established and filed with Party A.

8. According to the relevant safety management regulations of Beijing, regular construction of safety production inspections on the construction areas under its jurisdiction. When a safety hazard is found in the safety inspection, it shall be reported to Party A in a timely manner.

9. Regularly organize safety production training, education and safety production activities in accordance with Beijing's relevant safety management regulations. Party A may be required to provide assistance in safety education or safety activities if needed.

10. Before using the safety protection facilities provided by Party A, you should go through relevant procedures with Party A and be responsible for the safety maintenance during use. Responsible for production safety accidents caused by poor management during use.

11. Obey the civilized construction management of the construction site and be responsible for the civilized construction management within the construction area under its jurisdiction. Ensure the smooth flow of fire exits in the areas under its jurisdiction.

12. Party B shall bear the responsibility for accidents and economic responsibility when Party A or a third party is injured or injured due to a production safety accident caused by Party B's responsibility. Party A or a third party is obligated to assist in the handling of the aftermath.

13. Due to the production safety accident caused by Party A's responsibility, Party B is obliged to assist in handling the aftermath.

14. Due to production safety accidents caused by the responsibility of both parties, the corresponding accident responsibility and economic responsibility shall be assumed according to the responsibility of the relevant departments of the municipal government.

15. After a production safety accident occurs, it must be reported to Party A within 15 minutes and reported to the relevant competent department in accordance with the relevant regulations of Beijing. Late reporting or concealing will not report production safety accidents and bear full responsibility for the accident.

3. Party A and Party B strictly abide by the powers, responsibilities and obligations stipulated in this letter of responsibility, and clarify the respective responsibilities and duties of both parties in construction and production and strictly abide by them. The subordinate construction workers should always carry out legal education, safety education and compliance education. Both Party A and Party B must not violate the rules, operate illegally, or violate the labor discipline of "three violations". Strengthen safety production management, establish and improve the safety production responsibility system, improve safety production conditions, and ensure full production.

This Agreement is valid for one year from the date of signing. This letter of responsibility is in duplicate and each party holds one copy.
