7、堅持減輕農民負擔、確保農村社會穩定的原則。在農村產權制度改革中,僅依法收取權證工本費,嚴禁“搭車”收費,千方百計維護農村社會穩定。
Target task
自20XX年起,爭取用2年左右時間,基本完成農村產權制度改革任務,逐步建立健全現代農村產權制度。20XX年要完成資產資源確權、各類權證頒工作總量的50%以上,其中,林權證頒發工作要全部完成。
1、開展農村土地承包經營權、宅基地使用權、房屋所有權、林權、村集體各類資產資源產權和其他應該明確的產權的確權、登記、頒證工作。
2、建立完善農村資產資源規範化、制度化、長效化管理監督機制。嚴格耕地使用,完善保護機制。推行農村集體經濟“三資”委託代理,完善管理機制和監督機制。
3、培育和建立農村產權流轉市場,推動農村土地承包經營權、集體建設用地使用權、房屋產權、林權的流轉,加快農村產權要素市場化、資本化進程,激活盤活農村生產要素,促進農村資產資源最佳化配置和農村市場經濟體系的進一步完善。
二、把握關鍵環節,積極穩妥地推進農村產權制度改革
嚴密程式,規範操作
1、認真開展調查摸底、清產核資、核實確認工作。各區、縣要抽調專業人員和鄉鎮幹部組成工作組,會同村組人員進村入戶,調查、核實、統計農村土地承包經營權等基本情況,收集民眾反映的問題,並將核實的情況向民眾反饋。在權屬合法、數據準確、界址清楚的基礎上,依法逐戶登記,以村民小組為單位匯總造冊,作為頒證的依據。
2、深入做好數據覆核、公示、建檔造冊工作。通過清查摸底、核實確認無誤後,相關部門按照要求進行數據錄入,以村或組為單位,將各部門會審後形成的確權核實情況進行7天公示,公示期滿後再行覆核,確保數據的準確性,並依權屬分類建檔造冊保存。
3、嚴格遵照法律法規開展頒證工作。農業、城鄉建設、國土資源、林業、住房保障和房產管理等部門要根據《中華人民共和國土地管理法》、《中華人民共和國農村土地承包法》、《中華人民共和國森林法》、《中華人民共和國草原法》、《中華人民共和國經濟契約法》、《中華人民共和國物權法》、《中華人民共和國房地產管理法》、《中華人民共和國農村土地承包經營權證管理辦法》、《林木林地權屬登記管理辦法》、《土地登記辦法》和《房屋登記辦法》等法律、法規及政策規定,分別依法頒證。
發揚民主,依靠民眾
1、充分發揮廣大民眾的改革主體作用。各級黨委和政府要切實保障廣大農民的知情權、決策權、參與權和監督權,把具體問題的決定權、資產處置權、利益分配權交給農民民眾。特別是對一些歷史遺留問題和民眾意見分歧較大、民事糾紛較多等問題的處理,要堅持民事民議、民事民決,具體問題具體分析,切實維護和保障大多數農民民眾的合法權益。各村要以屯為單位,組建村民理事會,將為人正直、辦事公道、有一定威信,並熟悉掌握所在村、屯情況的人作為村民理事會成員,充分發揮理事會宣傳引領、參與調查摸底、協助處理矛盾糾紛的作用。
2、妥善解決疑難問題。各地區、各有關部門要堅持“只組織不干預、只引導不拍板、只協調不做主”的工作原則,按照“大事不出村、小事不出組”的要求,在具體問題的處理上做到“有法依法、無法依民”,對法律、法規及政策有規定的,按規定處理;對沒有政策規定、應由村級組織決定的,由村級組織作出決定;對應由農戶決定的,由村民理事會召集村屯戶代表會議進行決議。對歷史遺留、正在處理或正履行法律程式的問題,暫不確權登記,作為個案處理。
三、積極探索創新,不斷加大農村產權制度改革力度
推動土地承包經營權流轉。在堅持農村基本經營制度、土地用途不改變和依法、自願、有償的前提下,支持採取轉包、出租、互換、轉讓或其他方式流轉土地承包經營權;農戶可以委託集體經濟組織代為流轉其承包經營權;鼓勵農戶以土地承包經營權入股,組建土地承包經營權股份合作社,實現規模化經營。健全完善農村土地承包經營權和林權流轉管理辦法,建立市、縣、鄉三級土地承包經營權流轉、林權流轉服務中心,暢通供需信息。在條件成熟的區、縣建立區、縣域範圍內農村土地承包經營權流轉市場。探索建立政策性農村土地流轉擔保公司,促進土地流轉,保護農民利益。
開展農村集體建設用地使用權流轉試點。積極探索建立集體建設用地使用權出讓制度,依法促進集體建設用地使用權流轉。制定集體建設用地使用權流轉管理辦法,加強集體建設用地使用權流轉管理。國土資源部門負責集體建設用地使用權流轉的組織實施與監督管理。條件成熟的區、縣要探索建立集體建設用地使用權流轉交易市場。
開展農村房屋產權流轉試點。加快制訂農村房屋產權流轉管理辦法,鼓勵、支持發展農村房屋產權流轉中介服務機構,積極培育發展農村房屋產權交易市場。加強農村房屋產權流轉的管理,嚴格按照農村宅基地“一戶一宅”政策依法依規流轉,農戶出賣、出租住房後,不得再申請新的宅基地。條件成熟的區、縣要積極進行試點。
推進農村集體經濟組織產權改革。按照《農業部關於穩步推進農村集體經濟組織產權制度改革試點的指導意見》要求,以村、社區股份合作制為基礎,以加強農村集體資產經營管理為核心,以資產保值增值、增加農民財產性收入為目的,加快推進農村集體經濟組織產權改革,並嚴格按照制訂方案、清產核資、資產量化、股權設定、股權界定、股權管理、資產運營、收益分配、監督管理的程式進行。
