In order to clarify the obligations and obligations of the three parties, the “Construction Project Quality Margin Management Agreement” is signed by the three parties as follows:
1. Party A entrusts Party B to open a special project for “Quality Assurance” for the construction project of Party C. Party C deposits the “Quality Assurance Fund” into Party B according to the terms of the deposit in the construction contract, and Party B sets up a “Quality Assurance” account for the construction project, and The receipt of the payment notice is signed.
2. The "quality guarantee deposit" deposited by Party C can only be used to return the project contractor after the expiration of the engineering maintenance and engineering defect liability, and may not be used for other purposes.
3. If there is a quality defect in the construction project, if the original responsible unit fails to perform the maintenance duties within the stipulated time, Party A entrusts the unit with the corresponding qualification to carry out the repair. The actual expenses incurred can be paid from the “quality guarantee”, and Party B receives the repair. The repair fee may be paid to the maintenance unit after the written notice.
4. The project has reached the expiration of the defect, and it is determined that there is no quality defect in the relevant warranty items of the project. Party C signs the consent opinion on the “quality guarantee” return application submitted by the contractor and submits it to Party A. Party B must receive a written notice from Party A to issue a “quality guarantee” and then transfer the “quality guarantee” to the project contractor.
5. If Party B fails to receive the “Quality Guarantee” return or pay the written notice of the project maintenance fee, Party B shall return or misappropriate the “Quality Guarantee” without authorization, and Party B shall be responsible for all legal liabilities arising therefrom.
6. The unfinished matters of this Agreement shall be handled in accordance with the _________ file and relevant laws and regulations.
7. This Agreement shall be in three copies, and each of Party A, Party B and Party C shall hold one copy and shall enter into force after being signed and sealed by the three parties.
