Article 3 Quality Requirements

1. The variety, specification and name of the main materials used in the project are approved by both parties. For details, please refer to the attached file of the contract, the final list of home decoration engineering materials.

2. The project acceptance criteria, the two parties agree to refer to the Shanghai local standard db31/t30-1999 "Residential Decoration Acceptance Standards".

3. During construction, if Party A has special construction projects or special quality requirements, both parties shall confirm that the additional costs shall be signed separately.

4. Quality inspection and supervision department: Shanghai Interior Decoration Industry Association Family Decoration Professional Committee.

5. The quality of the materials and equipment purchased by Party A shall be borne by Party A; Party B shall be responsible for the construction quality.

6. If Party A self-employs the project supervision, Party A shall notify Party B before the commencement of the project to facilitate the work connection.

Article 4 Material Supply

1. Party B shall strictly follow the relevant national price regulations and impose a clear price on the materials used in this contract. For details, please refer to the attached file “Home Decoration Engineering Materials Budget Table”. The materials provided by Party A shall be applied to the decoration works specified in this contract, and may not be used for other purposes without the consent of Party A. If Party B uses it for other purposes, Party B shall compensate Party A according to the double price of the misappropriated materials.

2. If the materials and equipment provided by Party B do not meet the quality requirements or the specifications are different, it shall be prohibited. If it has been used, Party B shall be responsible for the losses caused to the project.

3. Party A is responsible for purchasing and supplying materials and equipment. For details, please refer to the contents of the attached file “Party List of Decorative Materials Provided by Party A”, which should be qualified products that meet the design requirements and should be supplied to the site on time. If the extension is reached, the construction period will be postponed and the penalty will be imposed according to the delay period. 10% of the total amount of materials provided by Party A shall be paid to Party B as management fee. After the materials have been checked and accepted by Party B, Party B shall be responsible for the custody. Party B shall be responsible for compensation for the loss caused by improper storage.

Article 5 Payment method

1. Once the contract is signed, Party A shall pay 100% of the engineering materials and construction work fees; when the construction period is more than half, Party A shall pay 40% of the construction work for the second time. The remaining 10% of the final payment will be settled by Party A after the completion of the project.

Party B issues a unified invoice and handles the transfer and distribution of the decoration project warranty card to Party A. Party A's non-payment on the due date is a breach of contract, and Party B has the right to stop the construction. When the acceptance of the unqualified project price is accepted, it shall not be delivered.

2. If there are any increase or decrease of project or need to be changed during the construction, please refer to the attached file “Home Decoration Engineering Project Change Form”. The two parties shall sign a supplementary contract, and Party B shall be responsible for issuing a construction change order to notify the person in charge of the construction site. . Increase or decrease the price of the project and settle it on the spot.

3. If Party A fails to prepay the project price within the time limit specified in this contract, Party A shall pay Party B 1% of the unpaid project price for each day overdue.

4. In the decoration of the living room, Party A shall hand over the mortgage certificate and related files to Party B if it is mortgaged to the bank.

Article 6 Project Duration

1. If the delay is completed due to Party B's reasons, 1% of the labor fee will be paid as a penalty fine to Party A until the payment of the work fee. If the completion of the work is delayed due to Party A's reasons, 1% of the labor cost in the decoration project will be paid to Party B as the lost time.

2. The materials and equipment selected by Party A will affect the quality and duration of the project due to unqualified quality. The rework fee shall be borne by Party A. Due to the construction accident caused by Party B, the rework cost shall be borne by Party B and the construction period shall remain unchanged.

3. During the construction, due to the quality of the project and the disagreement between the two parties, the work will be stopped. The two parties should take the initiative to request the mediation or arbitration department of the relevant department to coordinate and handle the dispute as soon as possible to continue the construction.

4. If the construction is required to be reworked due to Party A's reasons, or if the construction period is delayed due to Party A's change of construction, a visa is required. Party A shall bear all construction costs. If Party B causes rework due to Party B's reasons, Party B shall bear the responsibility. The construction period remains unchanged.

5. During the construction, Party A shall, without the consent of Party B, privately notify the construction personnel to arbitrarily change the quality problems caused by the construction contents and delay the construction period. Party A shall be responsible.

Article 7 Project Acceptance

1. Engineering quality acceptance, please refer to the attached file “Home Decoration Engineering Quality Acceptance Form” of this contract. Except for the concealed project, the Party shall organize Party A to complete the acceptance check. Both parties handle the procedures for settlement and handover of the project.

2. After Party B informs Party A of the process acceptance and completion acceptance, Party A shall come to the inspection within three days. If it is overdue, Party A shall automatically waive the right and be deemed to be qualified for acceptance. If there is any problem, Party A shall be responsible. Party A moves into the house and is deemed to have passed the acceptance test.

3. If Party A cannot come to the acceptance within the time limit specified by Party B, Party A shall promptly notify Party B to set a different date. However, Party A shall recognize the date of completion of the process or project and shall bear Party B's care fees and related expenses.

Article 8 Other matters

Party A

It is necessary to provide a plan of the house and a map of water, electricity and gas approved by the property management department, or provide the plan of the house and the water, electricity and gas road maps from Party A, and submit the site to Party B.

For the second decoration project, all the houses should be vacated or partially vacated, and the obstacles affecting the construction should be removed. For the furniture and furnishings that are retained in the houses that can only be partially vacated, necessary protective measures must be taken, and both parties must go through the formalities and bear the costs.

If it is really necessary to dismantle or renovate the original building structure or equipment or pipeline, it shall go through the formalities with the local housing management department and bear the relevant expenses. If you need to use the public parts temporarily during construction, you should say hello to the neighbors.

2. Party B

The company shall take the initiative to present the business license, membership certificate or construction qualification; if it is a subordinate branch, it must also have a certificate issued by the superior company; the salesman must have a certificate of the legal representative.

Assign __________ as the representative of Party B's construction site, be responsible for the performance of the contract, and organize the construction according to the contract requirements, and complete the construction tasks on time and in good quality and quantity.

Responsible for the safety of the construction site, prevent fires, affiliation, civilized construction, and prevent accidents caused by construction, such as pipeline blockage, water leakage, power outages, and damage to items. In the event of a failure, it is necessary to be responsible for repair or compensation as soon as possible.

Strictly perform the contract and implement the credit period. If the work is delayed due to delays, such as taking off materials, working or borrowing to induce Party A to pay the funds, the investigation will be based on breach of contract.

The warranty liability shall be borne within the scope of the decoration construction. The warranty period shall be 12 months from the date of the completion of the project completion inspection.

Article 9 Liability for breach of contract

After the contract is in force, the contract shall be terminated without authorization during the performance of the contract, and shall be paid to the other party as a penalty of 5% of the total amount of the contract. If the actual loss caused by the other party exceeds the liquidated damages due to unauthorized cancellation of the contract, compensation shall be made.

Article 10 Dispute Resolution

During the performance of this contract, if disputes arise between the two parties, the parties shall resolve the dispute without affecting the progress of the project. Or rely on this contract and the unified invoice issued by Party B to complain to the Shanghai Interior Decoration Industry Association Family Decor Professional Committee and request a solution.

If the parties are unwilling to resolve through negotiation or mediation, or if the negotiation or mediation fails, they may be directed in accordance with this contract--the arbitration commission applies for arbitration;-- the people's court filed a lawsuit.

Article 11 Change and Termination of the Contract

1. After the contract is signed by both parties, the parties must strictly abide by it. Any party that needs to change the contents of the contract shall re-sign the supplementary agreement after mutual agreement. If it is necessary to terminate the contract, the party who proposes to terminate the contract shall submit it in writing, and shall pay the liquidated damages at 10% of the total contract price and terminate the contract.

2. Any party who proposes to terminate the contract during the construction process shall submit it to the other party in writing. After the parties have agreed to go through the liquidation formalities and enter into the termination contract agreement, it may be deemed that the contract is terminated.

Article 12: The contract takes effect

1. This contract and the subsidiary file of the contract shall be sealed to both parties and shall become effective after being signed.

2. The supplementary contract has the same legal effect as this contract.

3. This contract is in the form of a copy of the contract between the two parties and the witness department.
