Shanghai Interior Design Entrustment Contract

According to the "Contract Law of the People's Republic of China" and other relevant laws and regulations, combined with the characteristics of interior decoration, Party A and Party B entrusted Party B to undertake the interior decoration design and reached the following agreement for mutual compliance.

1. Party A entrusts Party B to undertake the interior design according to the following scheme:

1. Party A entrusts Party B to undertake the residential interior design, address _________________, room type ______, use ______, use area ___________ square meters. Design charges are calculated based on the area used.

2. Party A entrusts Party B to undertake the public space interior design, address ____________, use _________, building area __________ square meters. Design charges are calculated based on the floor area.

2. Party A entrusts Party B to undertake the interior design. The design fee is _________ yuan per square meter, and the design fee is _________ yuan.

3. Party A shall pay 50% of the design fee in the first period on the date of signing the contract, and agree with Party B on the time and place of on-site measurement. Party B completed the preliminary design plan within _________ days after the measurement, including the floor plan, top layout and partial renderings.

4. After Party A and Party B have reached an agreement on the preliminary design plan completed by Party B, fill in the plan progress form and confirm it by both parties. Party A shall pay the balance of the design fee. Party B shall complete the complete decoration design drawing and construction drawing within _________ days from _________ _________ _________ to _________ _________ _________ .

5. The design fee paid by Party A does not include the structural design of the building main body. If Party A needs to change the main building and increase the load on the building, the original design unit or the design unit with the corresponding qualification level must produce the construction drawing and report to the property and relevant departments for written consent before the interior decoration design can be carried out.

6. After the completion of the complete set of drawings, Party A shall communicate with Party B if there is any change of opinion. Party B draws the revised drawings according to the negotiation plan, and fills in the plan progress form again, which is signed and confirmed by both parties. If Party A requests Party B to modify the drawings, the completion time of the drawings shall be postponed or otherwise agreed by both parties.

If Party A overturns the original design plan and requires a revision of the design plan, it shall negotiate to increase the corresponding design fee, and separately agree on the design time and process, and sign a supplementary agreement.

7. After both parties have confirmed the design plan and drawings, Party A must sign and approve, and Party B must submit the entire set of drawings to Party A and handle the handover procedures.

8. During the construction process, Party B shall appoint a designer to go to the site for one-off stakeout and construction plan delivery, and not less than three times to go to the site to guide the construction to achieve the design effect.

IX. Liability for breach of contract

1. If Party B fails to complete the design drawing within the agreed time and the extension time is within 20 days, each one-year extension shall be paid a penalty of 3% of the total design fee of Party A.

2. If Party B fails to complete the design drawing within the agreed time and the extension time is more than 21 days, Party A shall have the right to cancel the contract. Party B shall refund Party A's design fee and pay Party A a penalty of 50% of the total design fee.

3. Party B shall terminate the contract without any reason, in addition to refunding the design fee paid by Party A, it shall also pay a penalty of 50% of the total design fee of Party A.

4. After Party B completes the preliminary design plan, if Party A is unwilling to perform the contract again, Party B will not refund the design fee already received, but it must be handed over to Party A's floor plan, top layout and hand-painted partial renderings.

X. If there are any unfinished matters in this contract, the two parties may solve the dispute through negotiation. They may also apply to the Shanghai Interior Decoration Industry Association for mediation or complaints to the Shanghai Consumer Protection Committee. If the parties are unwilling to negotiate, mediate, or negotiate, and the mediation fails, the following _________ methods can be adopted:

1. Apply to the Shanghai Arbitration Commission for arbitration.

2. File a lawsuit in the people's court.

XI. This contract is made in two copies, each party holds one copy. This contract includes the subordinate file of the contract and the supplementary agreement. It will take effect after the signature or seal of both parties.

Instructions for use

1. The text of this contract is a model text formulated in accordance with the "Contract Law of the People's Republic of China", "Regulations on the Supervision of Shanghai Contract Format Terms" and relevant laws and regulations, which shall be agreed upon by the parties to the contract and shall be read carefully before signing the contract.

3. Party B shall provide Party A with the design drawings and materials, and shall be bound into a book according to the catalogue.

4. Special requirements and fire safety must be designed according to special requirements and fire safety requirements. Environmentally friendly materials must be considered during design.

5. The design drawings provided by Party B to Party A are as follows:

1. Drawing cover, back cover, design drawings;

2. Design drawing catalogue and design and construction instructions;

3. Original room type plane measurement chart;

4. The design requires demolition of the floor plan;

11. Reference drawings for furniture and kitchen design;

12. Stair design, installation and construction details;

13. Partial perspective

14. Estimated table of main decoration materials.

6. The text of this contract shall be jointly formulated by the Shanghai Administration for Industry and Commerce and the Shanghai Interior Decoration Industry Association. No unit or individual may reproduce it for commercial purposes.
