According to the "Economic Contract Law of the People's Republic of China", the company's project management implementation rules and the actual situation and characteristics of the four branches and the project department, Party A will entrust Party B to construct part of the civil engineering package clearing project. On the basis of the principle of equality and mutual benefit, the two parties signed the following contract terms on the basis of the original bidding and other related documents through friendly consultations, and the two parties abide by them.

The scope and content of a contracted work

Second contract price and settlement method

1. According to pumping 15.0 yuan / m3, non-pumping 20.0 yuan / m3. The point-cutting technician is 5 yuan/hour, and the general worker is 3 yuan/hour. The unit price includes labor costs, ultra-high fees, accommodation fees, travel expenses for entry and exit, labor protection fees, small tools, small equipment, pump and tube support detachment, pump tube cleaning and stacking, cleaning of mechanical equipment, and utilization of surplus materials. The management fee and handling fee of the five certificates, the cleaning of the construction joints, the chiseling, the surface cleaning of the steel bars, the maintenance of the concrete shall not be less than seven days, the walls and column facades shall not be dehydrated and corresponding measures shall be taken, as well as personal adjustment taxes.

2. On the 25th of each month, according to the approved construction quantity of the construction staff, the accountant will review the checkout. After the relevant departments review, 80% of the workload will be paid before the 10th of next month, and the remaining 20% ​​will be paid 10% by the end of the year. The remaining 10% is used as the safety quality guarantee. After the project is accepted and accepted, the relevant departments will pay the balance and pay the final payment.

Three labor service salary payment methods

Party B shall prepare a monthly material plan to report to the relevant personnel of Party A one month in advance, and jointly formulate the feeding plan to arrange the material arrival time reasonably. Strictly control the material consumption according to the material loss table formulated by the relevant construction department, and take corresponding reward and punishment measures.

Five duties

Party A's duties

1. Fully responsible for the preparation of monthly and quarterly production plans and labor plans for on-site construction, and coordinate work to ensure continuous, rational and balanced construction of the task.

2. Responsible for the guidance and quality supervision of on-site construction technical problems, timely conveyed in writing the work instructions, safety submissions, construction drawings and other technical related materials.

3. Responsible for providing Party B with water power supply within 40 meters from the working surface, horizontal or vertical distance, and ensuring the smooth construction and vertical transportation facilities requirements of the construction team.

4. According to the requirements of construction organization design and construction plan, the safety requirements of the construction team on the construction site and the safety of mechanical equipment must be guaranteed, and all the facilities needed for safe and civilized construction should be provided to the operators according to the application team.

5. It shall be responsible for timely handling the procedures for compensation for losses caused by Party A and the penalty for losses caused by Party B.

6. Responsible for the inspection and assessment of the safety, quality, progress and comprehensive management of Party B's operators, and has the right to review the management materials of Party B at any time.

7. Responsible for providing Party B with the conditions for accommodation and dining facilities, and conducting paid management and services. The monthly rent is 120 yuan/room, and the utility fee is 50 yuan/room.

8. Responsible for organizing Party B to participate in various activities such as the double civilization competition organized by the Party and Government Work Group of the Four Branches.

9. Party A has the right to order the B-party operators who violate the law and violate the rules and regulations to leave the project department within 24 hours.

10. Party A must apply to Party B for the transfer of equipment.

Party B's duties

1. Party B shall strictly abide by the management objectives promised by Party B in the contract, the bidding file and the inquiry record.

2. Responsible for the political thinking, technical training, professional ethics, and education of the workers.

3. In accordance with the spirit of the contract, timely report the labor settlement statement and various assessment statements to Party A in writing.

4. Responsible for the maintenance, maintenance and repair of machinery, equipment and tools provided by Party A, and strictly apply the limit materials according to the requirements of Party A.

5. Responsible for the safety and technical level three education and assessment work for the labor service personnel entering the construction site, and timely submit the written information of the work to the Quality and Technical Supervision Department of the four branches.

6. Party B shall appoint a representative to be on site to manage the labor service personnel, coordinate and inspect and evaluate the work and completion of each labor service team, and participate in the monthly project planning meeting and work coordination meeting of the project department on time.

7. The party must correctly and promptly handle the temporary residence permit, family planning certificate, employment permit, special work permit, employment certificate, and work contract procedures for the work personnel, and accept the inspections of the higher authorities, local government departments, and Party A at any time, and the non-compliance should be met. Rapid rectification of the requirements. Otherwise, Party B shall be responsible for the expenses incurred.

8. During the construction period of the project department, Party B's operators shall strictly implement the various regulations of the company and the management regulations issued by the four branches and the project department.

9. The Party B labor service team shall establish a management mechanism of “two long and six major members”, and the total number of technical backbones engaged in the work type of the work group for more than one year shall be more than 60%.

10. Configure personal labor protection facilities as required.

Six quality safety management

1. Applicable standards and specifications are GBJ301-88, construction drawings, construction plans, operation instructions, Yiwu supervision procedures, company warranty manuals, safety management and implementation of national safety operation regulations, and both parties shall implement the company's quality and safety awards and regulations.

2. Party B must strictly implement and comply with the four-level quality and safety inspection management program, and the quality of the sub-projects is over 90%. If the quality of the sub-projects is less than 80, Party B must rework unconditionally, resulting in Party A’s economy. The loss shall be borne by Party B by 40%, and Party A shall not organize the construction of the next process. When pouring, you must be careful and careful, to prevent the shock, and not to over-vibrate, to ensure that the external light is inside. The surface of the crucible is subjected to secondary calendering to control the thickness and flatness of the floor. Eliminate the phenomenon of honeycomb and exposed ribs, clean the surface of the column ribs in time, and clean the remaining layer of the lower layer.

4. The safety goal is to prevent serious accidents. The frequency of minor injuries is less than one thousandth. If a safety accident occurs, the direct economic responsibility shall be borne by the responsible party. 5. The standardization management target is the provincial standardization construction site.

The seven assessments and rewards and punishments make the project achieve the goal of safety, quality, speed and efficiency. The two sides agree on the following rewards and penalties:

1. The reward and punishment of the construction period: If Party B meets the requirements of the project plan confirmed by both parties, no penalty will be awarded. If Party A rewards Party B 200 yuan/day one day in advance, if Party B’s responsibility lags one day, Party A shall punish Party B for 400 yuan/day. If Party B’s responsibilities do not meet the requirements of the spirit of the coordination meeting of the project department, Party A shall punish Party B for 200 yuan/time.

2. Quality reward and punishment: If Party B's responsibility project quality does not meet the excellent requirements, Party B's final unit price will be reduced by 30%. If Party B's responsibility project quality does not meet the requirements for qualified products, Party B's unit price will be reduced by 100%. 3. Safety award: such as Party B Party A shall impose a fine of 500 yuan/time on Party B. If Party B is seriously injured, Party A shall impose a fine of 10,000 yuan/person on Party B. If Party B has not seriously injured, Party A shall give Party B 5,000 yuan. The rewards, such as Party B’s minor injury accident is less than one thousandth, Party A gives Party B a reward of 3,000 yuan.

4. Standardized management rewards and punishments: If Party B’s liability violates the provincial-level standard chemical land management regulations, Party A shall impose a fine of 500 yuan/time on Party B. If the project site is rated as a provincial-level standard chemical site, Party will give Party B a reward of 1,500 yuan.

5. Technological progress awards: If Party B proposes rationalization proposals and is approved by Party A for implementation, Party A will give Party B a reward of 200-1000 yuan.

6. Material Festival Super Awards: Party A shall, according to the relevant economic data, give Party B certain rewards and penalties in light of relevant specific matters, depending on the implementation status and effect of the quota picking system.

7. Comprehensive management rewards and punishments: If Party B’s personnel violate the law and discipline during the work of the project department, Party A has the right to impose a fine of 100-1000 yuan on the operation team.

Eight other

1. Final auditing program: Party B application → Construction staff auditing engineering quantity → Quality personnel confirming quality level → Project auditor reviewing unit price and engineering quantity → Material staff meeting sign → Project deputy manager approval → Project manager approval.

2. The tender file, the quotation, the notice of winning the tender and the relevant contents of the tender are all attached files of this contract and have the same legal effect.

3. Term of the contract: The contract is effective after signing by both parties. The validity period expires after the project starts to work and the account is settled.

4. The parties to this contract have not resolved the matter through negotiation.
