On the principle of equality, voluntariness, honesty and trust, Party A and Party B will negotiate with Party A to lease Party B's adsl broadband, and Party B shall provide Party A with access to internet services and other related agreements, and reach the following agreement:
Article 1 Lease Description Party A rents Party A's monthly subscription service. The nail side accesses Party B's Internet through adsl dialing. The location of the access is detailed in the business order.
Article 2 The type and quantity of leases shall be leased by Party A's adsl broadband Internet circuit, the number of which is _________, the rate is _________, and the telephone number is _________.
Article 3 Lease Term After the entry into force of this Agreement, the opening date of the service provided by Party B for Party A is the starting date of the circuit leased by Party A. Since Party B gives preferential price to Party A, Party A shall lease at least the period from the start. The day is calculated _________ years.
Article 4 Terms of Service
1. The Internet circuit maintenance interface between Party A and Party B is bounded by the adsl data machine.
2. Party B shall ensure the normal use of the leased circuit by Party A. For circuit failures, if it is confirmed that it is within the responsibility of Party B, Party B will, after receiving the application from Party A, deal with the handling of telecommunications obstacles in accordance with Article 33 of the Telecommunications Regulations of the People's Republic of China.
3. The circuit obstacles are confirmed and belong to the maintenance interface of Party A, which shall be resolved by Party A.
4. Party B will provide Party A with technical consultation on the circuit.
Article 5 Party A pays the fee and the time of payment
1. The agreement stipulates that Party A shall pay the Internet usage fee to Party B in accordance with _________. The calculation method of the fee is calculated according to _________, so the preferential price given is _________ yuan per month, and the one-time access fee is _________ yuan. After the circuit completion user signs and confirms, Party B starts to charge Party A. Party A shall pay the first month's network fee within seven days after the completion of the circuit; Party A shall pay the advance payment for the access service on time, which is a prerequisite for the entry into force of this agreement.
2. Party B shall provide Party A with the value of _________ yuan for adsl terminal equipment. The ownership of the adsl terminal equipment provided by Party B shall be owned by Party B. Party A shall keep the equipment and accessories intact when in use.
3. The two parties agree that Party A shall not handle the disassemble business within one year of using this business. If the disassemble business is handled for reasons of Party A, it shall pay the liquidated damages _________ yuan, and the equipment shall be recovered by Party B; After the year, Party A can handle the dismantling business and the equipment will be recovered by Party B.
4. Party B's circuit settlement month refers to the half-month charge from the 21st of last month to the 20th of this month and less than 15 days; the full month is charged for more than 15 days and less than one month.
5. If Party A fails to pay the fees within the time limit, Party B has the right to stop the processing of Party A's circuit, and does not handle any business during the period of Party A's arrears, and charges Internet charges as usual. Party B shall not be responsible for any losses arising therefrom.
6. For cash and transfer cheque users, Party B shall fax Party A's payment notice of Party B's monthly monthly subscription fee to Party A before the 25th of each month. Party A shall pay the monthly rental fee to the designated account of Party B before the 1st of the following month; for the transfer recipient, Party B will automatically collect the payment in the following month. If the rental fee is overdue for more than five days, Party B has the right to stop providing services to Party A and recover the arrears.
7. This preferential activity, Party A's access to adsl network computer number does not exceed _________ station is a prerequisite network access conditions, such as the number of users accessing more than 2 computers, according to the selected price 5 times the charge, and fill all Monthly fee.
8. Party A's service fee for renting Party B shall be implemented in accordance with the relevant provisions of this Agreement. If the current standard of China's current telecommunications tariffs is changed or adjusted, the price shall be agreed upon by both parties and confirmed in writing and executed according to the agreed standards.
Article 6 Party A's rights and obligations
1. Party A shall not use the terminal equipment that has not obtained the network access license of the industry management department in accordance with the relevant provisions of the State. Otherwise, Party A shall bear full responsibility.
2. Party A shall not use the services rented to engage in illegal activities such as endangering national security, revealing state secrets, and may not inspect, produce, copy, publish and disseminate information on obscenity and obstruction of public security.
Article 7 Rights and Obligations of Party B
1. Party B is responsible for ensuring smooth service and routine maintenance during the period of use of the circuit leased by Party A.
2. Party A's business on the leased circuit of Party B shall comply with the relevant regulations and regulations of the State Internet. Otherwise, Party B has the right to stop providing the service.
3. Since Party B's adsl service has higher requirements for telephone lines, if there is a reason for the line and user computer, it is impossible to open adsl broadband service for Party A, and Party B has the right to return the user's application.
Article 8 Opening and Interruption Compensation
1. The circuit leased by Party A, due to the interruption caused by Party B’s responsibility, shall not be handled within the specified time limit, and Party B shall compensate Party A. The compensation method is to extend the service time, that is, after the expiration of Party A's service, Party B provides Party A with twice the service interruption time as the compensation service time.
2. If Party B interrupts the service due to human factors such as test circuit, Party B must notify Party A in advance and obtain Party A's consent. Because of the test circuit requirements proposed by Party A and the line interruption caused by network expansion and cutover, it is not included in the interrupt compensation range.
Article 9 Liability for breach of contract
1. This Agreement is a trade secret and may not be circulated.
2. During the period of the agreement, either Party A or Party B shall not withdraw from the agreement at will. If one party breaches the contract, the observant party has the right to claim damages.
3. In the process of cooperation, the unfinished matters in the agreement shall be settled or supplemented by friendly negotiation between the two parties.
4. Failure by any party to perform any of the provisions of this Agreement is considered a breach of contract. The defaulting party shall bear the direct economic losses caused to the observant party due to its own breach of contract.
Article 10 If the parties have not done anything else , they may sign a supplementary agreement, which has the same legal effect as this Agreement.
Article 11 This contract is in quadruplicate, one for Party A and three for signature and seal of Party B.
Article 12 If there is a dispute between the two parties, try to resolve it by friendly negotiation.
