Temporary Convention for Owners (Demonstration)
Chapter I General Provisions
Article 1 According to the “Property Management Regulations” and relevant laws, regulations and policies, the construction unit shall, prior to the sale of the property, formulate this provisional convention, the use, maintenance and management of the relevant property, the common interests of the owner, and the obligations of the owner. Matters such as liability for violation of the Convention shall be agreed upon in accordance with the law.
Article 2 The construction unit shall express this temporary agreement to the buyer of the property before the sale of the property and explain it.
The written commitment of the property buyer to the construction unit to sign this property sale contract shall express the recognition of the contents of this provisional convention.
Article 3 This Provisional Convention shall be binding on the construction unit, the owner and the property owner.
Article 4 The agreement concerning the common interests of the owners in the preliminary property service contract signed between the construction unit and the property management enterprise shall be consistent with this provisional convention.
Chapter II - Basic Conditions of the Property

Article 6 According to the relevant laws and regulations and the property sale and purchase contract, the owner enjoys the ownership of the following property sharing parts and shared facilities:
1. The shared parts shared by all the owners of a single building, including the load-bearing structure, main structure of the building, public foyer, public corridor, public stairwell, outdoor wall, roof, —————,— -Wait;

Article 7 Within the property management area, according to the property sale and purchase contract, the following parts and facilities are owned by the construction unit:

The construction unit shall exercise the ownership of the above parts and facilities and equipment, and shall not affect the normal use of the property by the buyer of the property.
Chapter III - Use of the property
Article 8 The owner has the right to possess, use, profit and dispose of the exclusive part of the property, but shall not prevent other owners from using the property normally.
Article 9 Owners shall abide by the provisions of laws and regulations and provide power, water supply, heat supply, gas supply, drainage, passage, in accordance with the principles that are conducive to the use, safety, cleanliness, fairness and reasonableness of the property, and do not harm the public interest and the interests of others. Ventilation, lighting, decoration, environmental sanitation, environmental protection and other aspects of the relationship with neighboring owners.
Article 10 The owner shall use the property for the purpose of design. If it is necessary to change the design use of the property due to special circumstances, the owner shall, after obtaining the written consent of the neighboring owner, report to the relevant administrative department for approval and inform the property management enterprise.
Article 11 If the owner needs to decorate the house, he shall inform the property management enterprise in advance and sign an agreement on decoration and decoration management service.
The owner shall engage in decoration and decoration according to the agreement of the decoration and decoration management service agreement, obey the precautions of decoration and decoration, and shall not engage in the prohibition of decoration and decoration.
Article 12 The owner shall place decoration and decoration materials and decoration garbage at the designated place, and shall not occupy the shared parts of the property and public places without authorization.
The decoration and construction time of this property management area is - and construction is not allowed at other times.
Article 13 If the decoration and decoration house affects the normal use of the shared parts of the property, the shared facilities and equipment, and the infringement of the legitimate rights and interests of the neighboring owners, the owner shall promptly restore the original condition and bear the corresponding liability for compensation.
Article 14 The owner shall reasonably use the shared facilities and equipment such as water, electricity, gas and heating in accordance with relevant regulations, and shall not arbitrarily dismantle and modify it.
Article 15 The owner shall install air-conditioning according to the location reserved for design. If the design location is not reserved, it shall be installed according to the location specified by the property management enterprise, and the noise and condensed water shall be disposed of as required.
Article 16 Owners and property owners who use elevators shall abide by the regulations governing the use of elevators in the property management area.
Article 17 Driving and parking vehicles within the property management area shall comply with the rules of vehicle driving and parking in the property management area.
Article 18 The following acts are prohibited in the property management area:
1. Damage to the load-bearing structure and main structure of the house, destroy the appearance of the house, and arbitrarily change the design use of the house;
2. Occupation or damage to the shared parts of the property, shared facilities and equipment, and related venues;
3, illegal construction, private booths;
4. Dump or discard garbage and sundries at unspecified locations;
5. Violation of relevant regulations to stack flammable, explosive, highly toxic, radioactive materials, discharge toxic and hazardous substances, and emit excessive noise;
6. Hanging, posting, altering and portraying at the shared parts of the property and related places without authorization;
7. Use the property to engage in activities that endanger the public interest and infringe on the legitimate rights and interests of others;

Article 19 The owners and property owners shall not violate the relevant regulations in raising animals in the property management area, and shall abide by the following agreements:

Chapter IV - Maintenance and Maintenance of Property
Article 20 The owner's maintenance and repair of the exclusive part of the property shall not impede the legitimate rights and interests of other owners.
Article 21 When the maintenance and repair property needs to enter the exclusive part of the property of the relevant owner, the owner or the property management enterprise shall inform the relevant owner in advance, and the relevant owner shall give necessary cooperation.
If the relevant owner obstructs the maintenance and repair of the property and causes damage to the property and other losses, it shall be responsible for repairing and accepting the liability for compensation.
Article 22 In the case of an emergency that threatens the public interest or the legitimate rights and interests of other owners, it must promptly enter the exclusive part of the property for maintenance and repair but cannot notify the relevant owner. The property management enterprise may explain the situation to the neighboring owner. Under supervision, enter the relevant part of the property owner of the relevant owner for maintenance and repair, and notify the relevant owners in time and do a good job in the aftermath.
Article 23 If the owner does need to temporarily occupy or excavate roads or sites due to maintenance and maintenance of property or public interests, he shall obtain the consent of the construction unit and the property management enterprise, and restore the original state within the agreed time limit.
Article 24 When there is a potential safety hazard in a property that jeopardizes the public interest or the legitimate rights and interests of other owners, the responsible person shall take timely measures to eliminate hidden dangers.
Article 25 The construction unit shall bear the warranty responsibility of the property in accordance with the warranty period and warranty scope stipulated by the state.
If the construction unit refuses to repair or delay the repair within the warranty period and warranty, the owner may repair it by himself or by entrusting others. The repair cost and other losses caused during the repair period shall be borne by the construction unit.
Article 26 All the owners in the property management area shall deposit, use and manage the special maintenance funds for the property as required.
Chapter 5 - The common interests of the owners
Article 27 In order to safeguard the common interests of the owners, all owners agree to grant the property management enterprise the following rights in the property management activities:
1. In accordance with this provisional convention, cooperate with the construction unit to formulate rules and regulations on the use of common parts of the property and the use of shared facilities and equipment, public order and environmental sanitation;
2. Using criticism, persuasion, publicity, and other necessary measures to stop owners and property users from violating this provisional convention and rules and regulations;

Article 28 The construction unit shall set up a bulletin board in a prominent position in the property management area for posting the property management rules and regulations, and shall inform all owners and property users of the notices and announcements.
Article 29 Within the property management area, the property service charges shall be in a package-based manner. The owner shall pay the property service fees in full and on time in accordance with the provisions of the previous property service contract.
The property service fee is the basis for the normal development of property service activities and involves the common interests of all owners. The owner should actively advocate the arrears owner to fulfill the obligation to pay the property service fee.
Article 30 If the use of shared parts of the property or shared facilities and equipment is used for business operations, the relevant procedures shall be handled in accordance with the regulations after obtaining the consent of the relevant owners and property management enterprises. The proceeds from the owners are mainly used to supplement the special maintenance funds.
Chapter VI - Liability for breach of contract
Article 31 If the owner violates the provisions of this Provisional Convention on the use, maintenance and management of the property, which impedes the normal use of the property or causes property damage and other losses, other owners and property management enterprises may file a lawsuit in the people's court in accordance with this provisional convention. .
Article 32 If the owner violates the agreement on the common interests of the owners in this provisional convention, and the common interests of all the owners are damaged, other owners and property management enterprises may file a lawsuit in the people's court in accordance with this provisional convention.
Article 33 If a construction unit fails to perform the obligations stipulated in this provisional convention, the owner and the property management enterprise may file a complaint with the relevant administrative department, or may file a lawsuit with the people's court in accordance with this provisional convention.
Chapter VII - Attachment - then
Article 34 The exclusive part of a property referred to in this Provisional Convention means the house, space, site and related facilities and equipment that are used independently by a single owner and are exclusive.
The common parts and shared facilities of the property referred to in this Provisional Convention refer to houses, spaces, sites and related facilities that are owned or used by multiple or all owners except for the exclusive part of the individual owners in the property management area.
Article 35 When a property owner transfers or leases a property, it shall notify the property management enterprise in writing in advance, and require the property inheritor to sign the commitment of this provisional convention or the lessee promises to abide by this provisional convention in the lease contract.
Article 36 This temporary convention shall be held by the construction unit, the property management enterprise and each owner.
Article 37 This Provisional Convention shall come into force on the date of the promise of the first property buyer and shall terminate on the date of entry into force of the Owners' Convention formulated by the Owners' General Assembly.
