Remarks: According to the [Article 17] of the Marriage Law, the following properties are jointly owned by the husband and wife:

Other property that should be owned jointly.

Other property notes that should be placed on one side:

1. All of the above are general provisions, involving gifts and inheritance, with exceptions.

2. Gift: According to Article 22 of the Interpretation 2 of the Marriage Law, if the husband and wife get married, if the house is bought by one parent, the time of buying the house and getting married is different, and it is handled in two cases.

2.1 If it is a pre-marital parent who invests in the purchase of a marriage house, the money shall be deemed to be a personal gift to his or her child, which is personal property, but if the parent expressly gives the gift to both parties, it is a common property.

2.2 If the parents are paying a small couple to buy a house after marriage, the money should be counted as a gift to the husband and wife and is a common property. But if the parents explicitly give it up and only give it to their children, it is a personal property.

3. Inheritance: Parents die, children inherit heritage. If a parent is particularly wealthy, the child can inherit a huge amount of property. But no matter how large the number of these inherited property is, if there is no special statement, it is still the joint property of the husband and wife.

But there is one exception. If the parents follow the provisions of Article 22 of the "Marriage Law Interpretation II" regarding the gift, they will make a will in the notarization of the birth, especially mentioning that after their death, the property will be bequeathed to the child. Such property is only the personal property of the spouse. .

4. Personal property is still a personal property after marriage: both husband and wife, regardless of the gap between the rich and the poor before marriage, the marriage time is more than 8 years, the property owned by each of the two will be combined into one, converted into the joint property of the husband and wife. As long as it proves that this is personal property, no matter how many years of marriage, it is still personal property.

5. After the mortgage, the two people paid the mortgage loan, and the title certificate was the name of the woman. If one party proposes a divorce, it proposes to give up everything and the property rights of the house belong to the other party.

The property notary is a fixed evidence: the marriage of two people does not require all the property to be notarized. Like real estate, such as houses, cars, etc., because the registration system and property rights are clear, it needs to be notarized.

In the case of property rights that are subject to change at any time, valuables such as deposits, jade articles, gold and silver jewellery, heirlooms, computers, household appliances, furniture, etc., in order to avoid divorce, it is necessary to notarize.

If the contract has any unfinished matters, the two sides will resolve the dispute through negotiation. If the negotiation fails, the two parties may sue in the local court. The validity period of the contract is lifelong, and whether the renewal is due to be alive will take effect from the date of signature by both parties. This agreement is protected by law
