Article 5 Depositing self-raised funds

Party A shall, after signing this contract, open a current savings deposit account in Party B and deposit the self-reward funds into reserve. If you need to use Party A, the same family member, non-same spouse and non-same household blood pension fund to offset the self-reward fund, you need to provide proof of the written consent of the party, and submit Party B to apply for the transfer. Party A has already paid the self-raised funds to the sales unit for the first phase of the mortgage and the receipt can be waived.

Article 6 Loan disbursement

Party A who purchases a house from a sales unit or purchases a private house through the real estate transaction market hereby irrevocably authorizes Party B to deposit the loan amount together with the self-raised funds deposited within five business days from the date of approval of the mortgage registration. In the name of the purchase of the house by Party A, it is transferred to the account opened by the sales unit or the real estate transaction market.

If Party A builds, rebuilds, or overhauls self-occupied housing, Party B will actively transfer the loan funds to Party A’s current savings account deposit card account opened by Party B after the contract has been used up or will be used up. ) It is used according to the progress of the project.

Article 7 Loan repayment

The loan principal and interest are paid on a monthly basis.

Loans are repayable on a monthly basis from the month following the issuance. According to the calculation formula of equal repayment, calculate the monthly principal loan interest, and go to zero yuan to determine the monthly principal and interest, and the last principal and interest will be cleared.

The monthly principal and interest of the second period to the subsequent periods are calculated based on the personal housing provident fund loan interest rate announced by the bank in the current year, which is subject to the written notice of Party B, and changes the monthly principal and interest of the installment.

Party A needs to mobilize with himself, the same family member, non-resident spouse and direct blood relatives to repay the principal and interest of the loan, which can be processed once a year in the month of the year, and the formalities and the fifth provident fund of the contract are self-financing. Savings card, credit card repayment

Party A must apply for the China Construction Bank Shanghai Branch Savings Card, Credit Card, and Entrust Party B to repay the full amount of the principal and interest by means of automatic transfer, deposit it into the savings card account or credit card account, and ensure that Party B can implement the transfer repayment.

When the repayment of the card is failed due to Party A's reasons, Party A must hold the cash to the original loan to repay the loan.

Party A shall fully repay the outstanding principal of the loan in advance, and Party B shall not collect the early repayment of the hand fee, nor return the loan interest charged at the original contract interest rate.

Article 8 Loan Guarantee

The housing purchased by Party A under this contract shall be guaranteed by Party C in stages. Before the real estate title certificate is submitted to Party B for custody, if the borrower defaults on the loan principal and interest, penalty interest and related expenses for three consecutive months, Party C shall be responsible for the payment within 10 days after receiving the “Notice of Performance Guarantee” from Party B. pay off. The guarantee period shall be from the date of the loan to the date when Party B obtains the real estate title certificate.

During the guarantee period, Party A of Party B, and Party B's agreement to change the contents of the loan contract shall obtain the prior written consent of Party C.

Under this contract, Party A purchases, builds, rebuilds, and overhauls the housing as a mortgage guarantee for the loan. Party A and Party B separately sign the Housing Mortgage Contract. If Party A purchases the 期房, it shall submit the pre-sale contract for purchase to Party B for custody.

Article 9 Contract Notarization

Party A, Party B and Party C shall, within 10 days from the date of signing this contract, apply to the notary office for this contract and Party A, and the housing mortgage contract signed by Party B.

Article 10 Change and dissolution of the contract

After this contract comes into effect, neither party may change or terminate this contract without authorization.

If Party A transfers the rights and obligations under this contract to a third party, it shall comply with the relevant provisions and shall, in advance, obtain the written consent of the party, and the transfer shall take effect after the transferee and Party B re-sign the loan contract.

Article 11 Rights and Obligations of Party A and Party B

Party A has the right to request Party B to issue loans in accordance with the contract;

Party A shall return the principal and interest of the loan to Party B within the time limit agreed upon in the contract;

Party A must use Party B's loan according to the agreed purpose. Party A shall not use Party B's loan for other purposes without the written consent of Party B.

Party B shall issue the loan in time according to the time limit stipulated in the contract.

Article 12: Liability for breach of contract

During the execution of this contract, Party A fails to repay the principal and interest of the loan on a monthly basis, and Party B shall pay a penalty of _____ per ____ day for each ____ of the arrears; and Party A shall save or save during the current period. Article 13 This contract settlement method

In the event of a dispute arising from the performance of this contract, it may be settled through negotiation. If the negotiation fails, it may be brought to the people's court where Party B is located. During the negotiation or litigation, this contract does not involve the terms of the disputed part and must still be performed.

Article 14 Other agreed matters

Article 15 This contract shall become effective after the signing of Party A, Party B and Party C. Party C's guarantee responsibility shall be terminated by Party B's “Real Estate Warrants” and “Real Estate Other Warrants Certificate” purchased by Party A. Party A and Party B shall bear the responsibility until the loan principal and interest and related expenses under the contract are fully settled.
