According to the "Contract Law of the People's Republic of China", the "Regulations of the People's Republic of China on Telecommunications" and other relevant laws and regulations, Party A and Party B shall, on the basis of equality, voluntariness, fairness, and good faith, on matters related to mobile telephone network services. The agreement reached as follows:
The first network service area Party A provides network services, user services and various communication services that Party B applies for in the coverage of its promised mobile phone network.
If Party B applies for the opening of other communication services other than the default service, Party B shall go through the formalities and pay the fees according to Party A's regulations. International roaming services can only be enjoyed within the coverage of telecom operators' networks in countries and regions with automatic roaming agreements.
Article 2 When entering the network, Party B shall submit the following registration materials when handling the network access procedures:
1. Individual user: provide the original and valid identity document of this city;
2. Unit users: Provide the unit introduction letter, the original copy of the real and valid registration certificate, and the original identity document of the manager.
Party B shall use the mobile phone or other terminal that the country gives the network access permit mark. When applying for the opening of a new service item, it shall be equipped with a mobile phone or other terminal with corresponding functions, otherwise it shall bear the corresponding expenses and losses.
Article 3 User Data Party B shall ensure that the registration information of the network is true and accurate, and is obliged to cooperate with Party A to verify the registration data. During the period of validity of the contract, Party B shall promptly notify Party A to make corrections if there is any change in the registration information of Party B. If Party A finds that Party B's registration information is untrue and cannot contact Party B or Party B fails to cooperate in time, Party A has the right to suspend network service to Party B.
Party A shall be obliged to keep confidential the information and materials provided by Party B, and shall bear the losses caused to Party B by not fulfilling its confidentiality obligations.
The user service password is an important personal data of Party B, and Party B shall keep it in a safe place. Party B shall bear the losses caused by improper storage, but Party A shall be obliged to assist Party B or the public security organ to investigate the relevant circumstances.
Article 4 Fees and Fees Payment Party A shall collect the communication fee from Party B in accordance with the communication fee standard approved or filed by the relevant state department. Party B shall pay the communication fee in full according to the period specified by Party A.
In the event of a national adjustment of communication fee standards, it shall be implemented in accordance with the new standards from the time of adjustment as stipulated by the State. In the event that Party A issues a fee concession plan, it shall be executed according to the preferential criteria selected by Party B and from the time determined by the preferential plan.
If Party B fails to pay the communication fee in full within the agreed time limit, Party A has the right to stop the operation, and Party B shall pay the liquidated damages according to the standard of 3欠 of the outstanding amount; Party A shall pay Party B the amount of the arrears and liquidated damages. Within 24 hours, the network service will be resumed; if Party B has not paid the arrears and liquidated damages after 60 days of the down payment, Party A has the right to terminate the provision of network services and cancel the contract, and recover all the fees owed by Party B. .
In the case of arrears, Party B cannot handle other business except payment.
Article 5 Both parties to risk control shall conduct risk control on communication costs.
If Party B finds that the communication expenses have abnormally increased, it shall verify it in time, and Party A shall actively cooperate with the inquiry.
When Party B's unpaid communication fees reach the pre-sale limit indicated by Party A, Party A shall inform Party B by sending a brief message, etc. Party B shall pay the communication fee in time as required; when Party B's unpaid communication fee exceeds the pre-capacity amount, Party A has the right to stop the operation. .
Article 6 User Service Party A shall publicize information such as standard tariffs and payment deadlines at obvious locations in the business premises. Party B can also learn the above information through Party A's open customer service hotline, and consult about the network situation, business knowledge, service content and various temporary activities. Party A's customer service hotline is ______. Party B requires Party A to provide a list of charges for regional, long-distance and roaming calls that occur during the mobile phone call. Party A shall provide it free of charge; Party A shall clearly and clearly clarify Party B's questions regarding communication costs. Solution and verification.
Party A shall keep the detailed information of Party B's communication expenses within 5 months.
If Party A provides Party B with a service item that requires Party B to pay the monthly function fee, Party B shall obtain the consent of Party B. If Party B customizes it in self-service mode, Party A's retention period for the original custom certificate shall be no less than 3 months; if Party B has objection to the custom opening, it shall submit it to Party A during this period. If Party A opens the above service projects without authorization, Party B shall not collect the corresponding communication fees from Party B.
If Party A stops the Party B, it shall inform Party B in advance by means of a brief message.
Party A shall provide Party B with free access to the fire alarm 119, police 110, medical emergency 120, and traffic accident alarm 122 public welfare telephone.
Article 7 If Party B transfers the right to use the mobile phone number, Party B shall pay the communication fee first and handle the change registration with relevant documents.
Article 8 The SIM card stipulates that Party B can set and clear the personal password of the SIM card by itself. The initial PIN is 1234. When the wrong password is entered three times in a row, the card will be locked; when the card is locked, Party B shall not unlock it by itself, but should carry it into the network. When using the valid documents, go to the business premises of Party A to unlock. If the SIM card is damaged or permanently locked due to improper operation of Party B, Party B shall bear the relevant expenses for the card replacement.
Article 9 Quality of Service Party A shall provide Party B with prompt, accurate, safe and convenient network services and guarantee Party B's freedom of communication and communication secrets in accordance with the law.
Within the coverage of the network promised by Party A, Party B shall notify Party A of the service obstacles. Party A shall repair or revise it within 24 hours from the time of receiving the application; if it cannot be repaired or transferred as scheduled, it shall promptly notify Party B shall be exempt from the basic monthly fee and other fixed expenses during the period of the obstacle. Except for the reasons for the service caused by Party B.
If Party A's fault causes Party B's mobile phone to be down or sold in normal use, Party A shall immediately resume and waive the basic monthly subscription fee for the month.
When Party B applies for the opening of a service within the scope of Party A's commitment, Party A shall open it within the time limit promised. If Party A fails to open in time, the basic monthly fee for the period from the date of application to the opening of the service shall be reduced.
When Party B applies for the termination of a service to Party A, Party A shall handle it within 24 hours after acceptance. If Party A fails to stop the service on time, Party B shall not bear the monthly functional fee for the occurrence of the service, and the non-functional fee shall be waived for the basic monthly subscription fee.
In order to ensure the interests of Party B, Party A can freeze the mobile phone number of the sales number for at least 90 days before it can be put back into use.
If Party B discovers that the mobile phone or other terminal has been illegally stolen by others, Party B shall promptly notify Party A to stop the service. Party A shall assist Party B and the public security department in conducting investigations technically. Party A shall not bear the communication expenses and other losses incurred before receiving the notice of termination of service by Party B.
Article 10 Force Majeure Some or all of this contract cannot be performed due to force majeure, and the two parties shall not be liable for breach of contract.
Article 11: Due to technological advancement, Party A shall not be able to continue to perform this contract in order to improve the quality of service and improve the service telephone network. Party A shall inform Party B at least 90 days in advance and provide a reasonable solution. . Party B may negotiate with Party A regarding the solution, but Party A shall not be required to continue to perform this contract.
Article 12 Change of Contract A service promise made publicly by Party A in writing outside the contract in writing shall automatically become an integral part of this contract, except for the obligation of Party B to set an obligation or unreasonably increase the liability. If Party A's publicly committed standards of commitment are lower than those agreed in this contract, this contract shall prevail.
Article 13: If Party B requests the termination of the provision of network services, Party B shall go through the procedures for withdrawal of the network after paying the relevant fees. Party A shall actively handle it.
Article 14 Dispute Resolution Method The disputes arising under this contract may be settled by negotiation between the two parties; if the negotiation fails, Party B may appeal to the telecommunications administration department or complain to the relevant departments such as the Consumer Association; either party may sue in the people's court or Apply for arbitration in accordance with a separate arbitration clause or arbitration agreement.
