2. The reform direction of the service-oriented institutions is: to directly engage in production and business activities, directly transfer enterprises; for some of the business activities and public service, and adjust accordingly. In the future, it will no longer approve the establishment of institutions that engage in production and operation activities.

4. 2. Institutions engaged in production and business activities. 穩步推進承擔行政職能事業單位改革
根據國家有關法律法規和中央有關政策規定,按照是否完全或主要履行行政決策、行政執行、行政監督等職能,從嚴認定承擔行政職能的事業單位,不以機構名稱、經費來源、人員管理方式等作為依據。
對已認定為完全承擔行政職能的事業單位和主要承擔行政職能的事業單位在其他職責剝離後,在規範和調整其行政職能、重新核定人員編製的基礎上,可調整為相關行政機關的內設機構,確需單獨設定行政機構的,要按照精簡效能的原則設定。改革中涉及行政機構編製調整的,不得突破政府機構限額和行政編製總額,主要通過行政管理體製和政府機構改革中調劑出來的空額逐步解決。
已認定為承擔行政職能、但尚未調整到位的事業單位,在過渡期內繼續按照現行法律法規和政策規定履行職責,使用事業編製且隻減不增,依照現行機構編製、人事、財務、社會保險等政策規定實施管理。
對部分承擔行政職能的事業單位,要認真梳理職能,將屬於政府的職能劃歸相關行政機構;職能調整後,要重新明確事業單位職責、劃定類別,工作任務不足的予以復原或並入其他事業單位。
按照事業單位不再承擔行政職能的改革方向和管理要求,今後製定地方性法規、政府規章和“三定”規定等規範性檔案時,原則上不再授權或委託事業單位承擔行政職能。
積極推進從事生產經營活動事業單位改革
1.加快推進轉企改製。對從事生產經營活動事業單位要加快轉企改製,使其成為市場競爭主體。要周密製定轉企改製工作方案,按照有關規定進行資產清查、財務審計、資產評估,核實債權債務,界定和核實資產,由同級財政部門依法核定國家資本金。事業單位轉為國有企業的,要按現代企業製度要求,深化內部改革,轉變管理機製,並依照政企分開、政資分開的原則,與原行政主管部門脫鉤,其國有資產除國家另有規定外,由履行國有資產出資人職責的機構負責。鼓勵事業單位轉企的同時,進行產權製度改革,採取兼並、重組、股份製改造等多種形式,依法組建公司製企業、合夥企業或個人獨資企業。轉企改製單位要按規定登出事業單位法人,核銷事業編製,進行國有資產產權登記、工商登記,並依法與在職職工簽訂勞動契約,建立或接續社會保險關系。

強化協同配合。事業單位清理規範和分類改革工作是一項復雜的系統工程,要在市委、市政府的統一領導下,由機構編製部門牽頭,紀檢、組織、財政、人力資源和社會保障等相關部門按照各自職責認真做好相關工作。組織部門負責事業單位領導班子的及時調整和配備;財政部門負責製定配套財政政策,做好事業單位機構整合過程中國有資產清算、移交和債務清理等工作,並根據清理規範後的事業單位機構編製情況合理安排財政預算;人力資源和社會保障部門負責協助事業單位主管部門做好人員的調整安置工作和涉及的養老保險等社會保障工作;審計部門負責領導幹部經濟責任審計和財務收支審計工作;國有資產監管部門要加強事業單位轉製後國有資產的監督管理,做好機構變動單位資產劃轉處置等工作,防止國有資產流失。其他相關部門也要做好相應工作,確保改革工作順利進行、圓滿完成。
Serious work discipline.各縣區、各部門要嚴格執行機構編製管理有關規定,不得擅自定機構、定編製、提高機構規格、超職數配備幹部、超編進人。事業單位清理規範和分類改革實施期間,機構編製總量隻減不增,除上級有明確要求外,一般不再審批新的事業單位。要嚴肅組織、人事、財經紀律,強化國有資產監管,不得突擊提拔幹部、評定職稱、分錢分物。對違反有關規定、造成惡劣影響的,要嚴肅追究有關領導和相關人員的責任。
篇三:事業單位分類改革實施方案
為全面貫徹落實黨的十八大精神,推動我省公益事業又好又快發展,根據《中共中央國務院關於分類推進事業單位改革的指導意見》,結合江蘇實際,現就分類推進我省事業單位改革提出如下實施意見。
一、指導思想、基本原則和主要目標

高舉中國特色社會主義偉大旗幟,以鄧小平理論、“三個代表”重要思想、科學發展觀為指導,按照政事分開、事企分開和管辦分離的要求,以促進公益事業發展為目的,以科學分類為基礎,以創新體製機製為核心,堅持分類指導、分業推進、分級組織、分步實施的工作方針,進一步增強事業單位活力,不斷滿足人民民眾日益成長的公益服務需求。

堅持以人為本,發展公益事業,把提高公益服務水準、滿足人民民眾需求作為出發點和落腳點;堅持分類指導,明確功能定位,根據不同類別事業單位的特點,實施改革和管理;堅持開拓進取,創新體製機製,破除影響公益事業發展的體製機製障礙,大膽進行多種形式的探索和實踐;堅持著眼發展,最佳化資源配置,充分發揮政府主導、社會力量參與和市場機製的作用,實現公益服務提供主體多元化和提供方式多樣化;堅持統籌兼顧,整體配套銜接,註意與行業體製改革、政府機構改革等相銜接,妥善處理改革發展穩定的關系。

改革的整體目標是:2020年前,建立起功能明確、治理完善、運行高效、監管有力的管理體製和運行機製,形成基本服務優先、供給水準適度、布局結構合理、服務公平公正的具有江蘇特點的公益服務體系,為全省率先基本實現現代化提供重要支撐。有條件的地區可適當提前。
改革的階段性目標是:20XX年12月底前,全面完成事業單位分類工作。2019年12月底前,基本完成承擔行政職能事業單位和從事生產經營活動事業單位改革工作,從事公益服務事業單位在機構編製、人事管理、收入分配、社會保險、財稅政策等方面的改革取得明顯進展,管辦分離、完善治理結構等改革取得較大突破,社會力量興辦公益事業的製度環境進一步最佳化,為全面建成惠及全省人民的更高水準小康社會提供重要保證。
Second, the work task
按照社會功能科學劃分事業單位類別
在前期清理規範的基礎上,明確事業單位分類範圍,規範事業單位分類標準,嚴格事業單位分類程式。按照社會功能,將現有事業單位劃分為承擔行政職能、從事生產經營活動和從事公益服務三個類別。根據職責任務、服務對象和資源配置方式等情況,將從事公益服務事業單位細分為兩類:承擔義務教育、基礎性科研、公共文化、公共衛生及基層的基本醫療服務等基本公益服務,不能或不宜由市場配置資源的,劃入公益一類;承擔高等教育、非營利醫療等公益服務,可部分由市場配置資源的,劃入公益二類。今後,不再批準設立承擔行政職能事業單位和從事生產經營活動事業單位。
穩步推進承擔行政職能事業單位改革
根據國家有關法律法規和中央有關政策規定,按照是否完全或主要履行行政決策、行政執行、行政監督等職能,從嚴認定承擔行政職能的事業單位,不以機構名稱、經費來源、人員管理方式等作為依據。
對已認定為完全承擔行政職能的事業單位和主要承擔行政職能的事業單位在其他職責剝離後,在規範和調整其行政職能、重新核定人員編製的基礎上,可調整為相關行政機關的內設機構,確需單獨設定行政機構的,要按照精簡效能的原則設定。改革中涉及行政機構編製調整的,不得突破政府機構限額和行政編製總額,主要通過行政管理體製和政府機構改革中調劑出來的空額逐步解決。
已認定為承擔行政職能、但尚未調整到位的事業單位,在過渡期內繼續按照現行法律法規和政策規定履行職責,使用事業編製且隻減不增,依照現行機構編製、人事、財務、社會保險等政策規定實施管理。
對部分承擔行政職能的事業單位,要認真梳理職能,將屬於政府的職能劃歸相關行政機構;職能調整後,要重新明確事業單位職責、劃定類別,工作任務不足的予以復原或並入其他事業單位。
按照事業單位不再承擔行政職能的改革方向和管理要求,今後製定地方性法規、政府規章和“三定”規定等規範性檔案時,原則上不再授權或委託事業單位承擔行政職能。
積極推進從事生產經營活動事業單位改革
1.加快推進轉企改製。對從事生產經營活動事業單位要加快轉企改製,使其成為市場競爭主體。要周密製定轉企改製工作方案,按照有關規定進行資產清查、財務審計、資產評估,核實債權債務,界定和核實資產,由同級財政部門依法核定國家資本金。事業單位轉為國有企業的,要按現代企業製度要求,深化內部改革,轉變管理機製,並依照政企分開、政資分開的原則,與原行政主管部門脫鉤,其國有資產除國家另有規定外,由履行國有資產出資人職責的機構負責。鼓勵事業單位轉企的同時,進行產權製度改革,採取兼並、重組、股份製改造等多種形式,依法組建公司製企業、合夥企業或個人獨資企業。轉企改製單位要按規定登出事業單位法人,核銷事業編製,進行國有資產產權登記、工商登記,並依法與在職職工簽訂勞動契約,建立或接續社會保險關系。
2.製定完善相關政策。為平穩推進轉企改製工作,可給予過渡期,一般為5年。在過渡期內,對轉企改製單位給予適當保留原有稅收等優惠政策,原有正常事業費繼續撥付。在離退休人員待遇方面,轉企改製前已離退休人員,原國家和省規定的離退休費待遇標準不變,支付方式和待遇調整按國家和省有關規定執行;轉企改製前參加工作、轉企改製後退休的人員,基本養老金的計發和調整按照國家和省有關規定執行,保證離退休人員待遇水準平穩銜接。在醫療保障方面,離休人員繼續執行現行辦法,所需資金按原渠道解決;轉企改製前已退休人員,轉企改製後繼續按規定享受職工基本醫療保險、補充醫療保障等待遇。有條件的轉企改製單位,可按照有關規定為職工建立補充醫療保險和企業年金。要進一步做好離退休人員的服務管理工作。
深化從事公益服務事業單位改革
1.最佳化布局結構。加強公益事業的統籌規劃,推動社會事業發展規劃、重大社會公益項目立項與事業單位機構編製管理的有效對接,為社會力量參與舉辦公益事業留下足夠空間。打破條塊分割和行政區劃界限,整合職責功能相近的事業單位,提升公益服務能力。最佳化事業單位層級分布,面向社會提供公益服務的事業單位原則上實行屬地管理,省級主要舉辦承擔全省性、示範性或者跨區域、跨流域公益服務事業單位。
2.改革管理體製。實行政事分開,理順政府與事業單位的關系。行政主管部門要加快職能轉變,創新管理方式,減少對事業單位的微觀管理和直接管理,強化製定政策法規、行業規劃、標準規範和監督指導等職責。對面向社會提供公益服務的事業單位,積極探索管辦分離的有效實現形式,逐步取消行政級別,落實事業單位法人自主權,保證其依法決策、獨立自主開展活動並承擔責任。
3.規範和創新機構編製管理。貫徹落實《江蘇省事業單位機構編製管理辦法》,全面規範從事公益服務事業單位的機構編製事項。對不同類型事業單位實行不同的機構編製管理。推進事業單位機構編製科學化、規範化、法製化管理。建立健全“控製總量、盤活存量、最佳化結構、有減有增”的動態管理長效機製,用好用活現有編製資源。進一步強化機構編製管理與組織管理、財政預算等綜契約束機製。加快建立事業單位機構編製執行情況和公益性職責履行情況的定期評估製度。探索對事業單位部分崗位實行政府購買服務的辦法。
