Second project settlement

Article 3 Project Quality

Party A shall carry out technical disclosure and organization acceptance according to the national quality acceptance specifications and assessment standards. Party B shall carefully organize the construction according to the construction drawings and specifications to ensure the quality of the project. If the quality is not up to standard, it must be reworked and repaired. The loss of the materials and materials shall be borne by Party B. If the quality of the work is inferior and cannot be saved, Party B shall be responsible for compensating for the loss of all materials.

Article 4 Safety Production

1. Party A shall make a safe disclosure of the project undertaken by Party B, put forward clear safety requirements, and conduct supervision and inspection. Party B must conscientiously implement the rules and regulations concerning safe construction, strictly abide by the safe operation procedures, and provide safe living facilities for Party A. Party B can only use it after passing the inspection. If a casualty accident occurs during the construction due to violation of the above regulations, Party B shall be responsible for the loss.

2. Labor protection articles and live operating appliances used by individuals, such as insulated gloves and rubber boots, shall be resolved by Party B in principle. If Party B does have difficulties, it may propose a plan to be used and Party A shall assist in the settlement.

3. In the course of construction, Party B shall be responsible for the fire accident caused by Party B's violation of fire regulations and regulations.

Article 5 Life Management

1. After Party B's workers enter the scene, the accommodation and accommodation problems provided by Party A and the main cooking utensils shall be kept by Party B. 2. The food and oil used for daily life shall be taken care of by Party B. Party A shall provide convenience in medical and health care. Article 6 Unit price of labor costs for subcontracted projects

Article 7 Material Supply Management

Party B shall set up a special person to handle the limit collection procedures for cement, steel, commodity components, hardware, linoleum, asphalt and special materials for water, electricity, heating and sanitation. Party B shall strictly follow the quality requirements and material mix ratio provided by Party A. The waste of materials used in the construction of Party B and the unreasonable excess of the quota shall be borne by Party B. Party B shall use the materials according to the materials during the construction, so that the daily war will be cleared, the materials will be cleaned, and the site will be kept clean.

Article 8 Construction Machinery

First, the large-scale tools are the responsibility of Party A to ensure the use of the need.

Second, the hand-held operating tools are handled by Party B.

3. Party B shall take care of the equipment that Party A is responsible for, and Party B shall be responsible for compensation if there is any loss.

4. The medium and small-sized machinery required for construction shall be equipped by Party A according to the construction plan. One machine is generally equipped with a driver to ensure the normal construction of Party B. Party B is not allowed to operate the equipment without authorization.

Article 9 Site Management

1. Personnel of Party A and Party B shall strictly abide by the various management systems on the site and organize the construction under the unified leadership of Party A's on-site personnel. The parties involved in the planning progress and material supply shall cooperate closely to ensure smooth construction.

2. Party B shall obey the law-abiding and safe production of construction workers, protect the education of the property, and appoint a special person to be responsible for on-site security work. It is strictly forbidden to steal on-site materials. If the site management system and illegal activities are violated, Party A has the right to take necessary measures. Party B shall bear legal responsibility and be responsible for compensation for economic losses.

Third, the subcontractors should be relatively stable, wear work signs when entering and leaving the construction site, and not allow people outside the contract to enter and leave the site and accommodation.

Article 10 Liability for breach of contract

1. Projects subcontracted by Party B shall not be subcontracted. In the course of construction, the inspection fails to meet the national acceptance specifications, and the quality of the project cannot be guaranteed. Party A has the right to terminate the contract, resulting in rework due to loss, and Party B shall compensate.

2. After the contract is signed, neither party may arbitrarily change or cancel it without the consent of both parties. If Party B fails to cancel the contract unilaterally without Party A's consent, Party B shall compensate Party A for the economic losses caused by Party A's impact on the construction plan; if Party A cancels the contract midway, Party B shall compensate Party B for the economic losses caused thereby.

3. Party B must complete the project according to the time limit and quality requirements stipulated in the contract. Otherwise, for each day after the expiration, Party A shall pay Party A the overdue liquidated damages of 2% of the labor cost of the subcontracted project.

4. Both Party A and Party B shall not owe all kinds of payables for arrears. If they are not paid in arrears, they will repay the overdue payment of liquidated damages according to the bank's short-term loan interest rate.

Article 11 Supplementary Provisions

1. In the event of a dispute arising from this contract, both parties shall consult in time. If the negotiation fails, either party may apply to the urban and rural construction committee at all levels or the competent department of the higher authorities for mediation. If it cannot be solved, it may apply to the district or county economic contract arbitration committee where the building is located to apply for arbitration, or directly to the people's court.

Second, this contract is a copy. Both Party A and Party B will each hold one copy. The remaining copies are submitted for filing.

3. If the certificate is required for verification, it may go to the district or county administration for industry and commerce at the place where the building is located for attestation or notarization at the notary office.
