2. Description

The construction project contract is a contract that is based on the construction project, including the construction contract, the architectural survey contract, and the architectural design contract. Construction contracting is a very complicated contract. It involves engineering technical standards, quality supervision and inspection, construction deadlines, etc., and there are many laws and regulations involved. Therefore, the establishment of construction contracting contracts should make specific provisions according to different situations, and strive to be accurate, clear and correct to ensure the smooth progress of the project. In particular, the technical terms and meanings of different projects are often different. Therefore, it is more necessary to specify the legal and technical standards and their meanings that should be applied when entering into a contract. In general, the following three aspects of the problem should be noted:

As a contractor, we must first understand the basic conditions of the project, including the drawings provided by the contractor, the amount of work, the difficulty of the project, the requirements of the construction period, and the construction strength that needs to be achieved. If the construction strength of the contractor is not suitable for the project, it should be stated, otherwise, it should bear the corresponding responsibility.

As the contractor, the contractor’s qualification level should be reviewed and whether there is any power to contract the project. Whether or not the contractor is allowed to subcontract should be stated in the contract in advance.

The Employer shall strengthen the supervision and inspection of the quality of the project. The mode, time and project content of the supervision shall be clearly defined in the contract; appropriate arrangements shall be made for the part requiring intermediate acceptance.
