Article 2 The entrusting party shall fill in the construction project survey design and design power in accordance with the provisions of this contract.

Article 3 The basis for the fee for survey and design fees and the standards for fee collection shall be implemented in accordance with state regulations.

For the appropriation method of survey and design fees, the entrusting party shall pay the deposit to the contractor within one day after the contract takes effect.

After the performance of the contract, the deposit will be used as the survey and design fee. If the contract is insufficient, the client should settle it once in a day.

The deposit for the survey mission is 30% of the survey fee, and the deposit for the design task is 20% of the estimated design fee. The survey fee for this project is the yuan estimate design fee.

If the entrusting party fails to perform the contract, it has no right to request a refund of the deposit; if the contractor fails to perform the contract, it shall return the deposit twice.

Article 4 Obligations of the Principal

1. The Principal shall provide the Contractor with the necessary information and shall be responsible for the time, schedule and reliability of the information provided within the agreed time.

The content, technical requirements and duration of the information provided are set out in Schedule 3.

2. When the survey and design personnel enter the on-site operation or cooperate with the construction, they shall be responsible for providing the following working and living conditions:

3. The entrusting party cooperates with the design task of the introduced project, and participates in the various stages of inquiry, external negotiation, domestic and foreign technical investigation, and completion and commissioning, and should accept the contractor who undertakes the relevant design tasks.

4. According to the relevant regulations, the survey and design fee collection standard will be paid to the contractor for survey and design fees as scheduled.

5. The survey results and design files of the contractor shall not be modified or transferred to a third party for reuse.

Article 5 Obligations of the Contractor

1. The contractor shall submit the relevant survey results and design files before the date of the year and shall bear the responsibility.

Submit the scope, schedule and quality of the survey results, as well as the stage, schedule, quality and design file size of the design. See attached table IV for details.

2. After the preliminary design has been reviewed by the higher authorities, the contractor shall be responsible for the necessary modifications within the scope of the original mission statement. When there is a major change in the original task book and the design is reworked or modified, it must have the opinion of the design approval authority or the design task approval authority.

3. The design unit shall cooperate with the construction project of the design task book, carry out the design technology, solve the design problems in the construction process, be responsible for design change and revision budget, participate in the test evaluation and project completion acceptance. For large and medium-sized industrial projects and complex civil projects, field design representatives should be sent and participate in concealed project acceptance. The cost of resident representatives is negotiated by both parties.

Article 6 Liability for breach of contract

1. Due to the poor quality of the survey and design, the project will be reworked, or the survey and design files will not be submitted on time to delay the construction period and cause losses. The contractor will continue to improve the survey and design tasks, and reduce or reduce the survey and design fees. The specific provisions are as follows:

2. In case of major quality accidents caused by survey and design errors, the contractor shall, in addition to exempting the survey and design fees from the lost part, pay compensation equal to the survey and design fee directly charged by the entrusting party.

3. The contractor shall not submit the survey results and design files within the time limit stipulated in the contract. Each delay shall be paid to the entrusting party for a penalty of 5‰ according to the survey design fee.

4. Due to the change of the plan, the inaccurate information provided, and the rework, work or modification design of the survey and design work caused by the failure to provide the necessary information or working conditions for the survey design, the entrusting party shall increase the payment according to the actual workload of the contractor. . 5. The survey and design costs shall be increased separately due to the major rework or rework design of the survey and design work caused by the principal's responsibility.

6. When the entrusting party pays more than the date specified in the contract, it shall pay the overdue liquidated damages. Each time the liquidated damages are overdue, it shall be calculated at 5‰ of the survey and design fee of the project.

Article 7 Ways to resolve disputes

In case of disputes during the execution of the contract, both parties shall resolve the matter in a timely manner. If the two parties belong to one department and the mediation is carried out by the competent department at a higher level; if the mediation fails or the parties do not belong to the same department, either party to the contract may apply to the Economic Contracts Arbitration Committee of the Trade and Industry Bureau for arbitration, or directly to the people's court. .

Article 9 Supplementary Provisions

Matters not stated in this contract shall be implemented in accordance with the provisions of the Economic Contract Law of the People's Republic of China and the Regulations on Construction Engineering Survey and Design Contracts.

The sub-files of this contract: "Construction Engineering Design Power of Attorney", "Engineering Geological Prospecting Power of Attorney", "Construction Archives and Survey and Design Basic Data Delivery Date List", "Review and Design File Delivery Date List" are all part of this contract. , with the same legal effect.

This contract shall take effect from the date of signature and seal by both parties. The original is two copies, and the entrusting party and the contractor shall each hold one copy; the copies shall be submitted to the competent department of administration, the Administration for Industry and Commerce and the Construction Bank for the record.
