Article 2 Description of travel expenses
1. The travel expenses paid by Party A in accordance with the provisions of Article 1 of this contract include the following items:
1) Fees for handling the documents: Party B will handle the handling fee for the required travel documents on behalf of Party A.
2) Transportation ticket fee: Party B shall purchase the transportation ticket for the public transportation department such as civil aviation, railway, highway and water transportation.
3) Catering and accommodation expenses: The catering and accommodation expenses arranged by Party B listed in the “Team Operation Plan”.
4) Tour Fee: The tour fee arranged by Party B listed in the “Team Operation Plan” and the first ticket fee for the scenic spot.
5) Transfer fee: The transfer fee from the airport, port, station, etc. to the hotel, accommodation to the place of tour during the tour.
6) Tourism service fee: Party B provides the fees charged for various travel services.
7) Other expenses agreed by Party A and Party B: ________________________.
If the transportation fee listed in the preceding paragraph is adjusted by the government, the refund and replenishment of the fee shall be handled in accordance with Article 63 of the Contract Law; the catering and accommodation expenses shall be arranged by Party B if Party A requests to raise the standard. The required difference should be paid.
2. The travel expenses paid by Party A in accordance with the provisions of Article 1 of this contract do not include the following items:
1) Construction fees for airports around the country.
2) Party A's personal expenses incurred during the trip, such as personal food and beverage expenses on transportation, personal injury and medical expenses, overweight baggage charges, laundry, telephone, telegraph, beverage and alcoholic fees, private transportation fees, freedom during travel accommodation Activity fees, baggage storage fees, fees and remuneration for the recovery of personal lost items, and compensation for personal actions during the journey.
3) The personal accident insurance expenses of Party A's self-insurance.
4) Other project costs agreed by Party A for their own separate payment.
5) Other expenses other than the aforementioned items.
Second, the obligations of both parties
Article 3 Party A shall perform the following obligations:
1. The documents and related materials provided by Party A must be true and valid.
2. Party A shall ensure that its physical conditions are suitable for participating in tour groups.
3. Party A shall properly keep the baggage items carried with you, and if it is not damaged or lost by Party B, it shall be responsible at its own risk.
4. Party A shall abide by the team discipline in the tourism activities, properly supervise the accompanying children, and cooperate with the tour guide to complete the travel itinerary.
5. Party A shall respect the religious beliefs, national customs and customs of the destination.
Article 4 Party B shall perform the following obligations:
1. Party B shall remind Party A to pay attention to the terms of exemption or restriction of its responsibilities, and explain the relevant provisions in accordance with the requirements of Party A.
2. Party B shall properly keep all the documents required for Party A to handle the tour. If any of the documents submitted by Party A shall be properly kept, if it is lost or damaged, it shall immediately take the initiative to reissue the fee and compensate for the direct loss caused to Party A. .
3. According to the contract, there is no tour team or tour team with the team leader. Party B should inform Party A of the specific contact method of the tourist destination.
4. If Party A suffers personal injury or property damage when traveling by plane, ship, train, coach, MRT, ropeway, cable car and other public transportation vehicles due to Party B's reasons, Party B shall assist Party A in the above-mentioned operations. Claim.
5. Party B shall arrange Party A's shopping in accordance with the "Team Operation Plan", and shall not force Party A to shop, and may not collude with the goods operator to swindle Party A's shopping.
6. Party B shall remind Party A to carry ____________ and other documents when traveling.
Third, Party A’s liability for breach of contract
Article 5 Party A may notify Party B to terminate the contract before the start of the tourism activity, but the liquidated damages shall be paid according to the following criteria:
1) If you notify before the 5th day before the start of the agreed tour, you will pay 10% of the total travel expenses.
2) If you notify before the 5th to 4th day before the start of the agreed tour, pay 20% of the total travel expenses.
3) If you notify before the 3rd to 2nd day before the start of the agreed tour, you will pay 30% of the total travel expenses.
4) If notified on the 1st day before the start of the agreed tour, pay 50% of the total travel expenses.
5) Pay 100% of the total travel expenses if notified or not notified after the start or start of the agreed tour.
Article 6 If Party A fails to arrive at the agreed place on time and does not join the tour group midway, it shall be deemed that Party A has cancelled the contract. Party B may deal with it in accordance with the provisions of Article 5, Item 5 of this contract.
Article 7 If Party A leaves the group without the consent of Party B during the journey, it shall be deemed that the contract shall be unilaterally terminated and Party B shall not be required to return the travel expenses. If Party A causes losses to Party B, Party A shall be liable for compensation.
4. Party B’s liability for breach of contract
Article 8 In addition to the circumstances stipulated in Article 7 of this contract, if Party A’s tourism activities cannot be cancelled due to Party B’s reasons, Party B shall immediately notify Party A to refund Party A’s travel expenses and meet the following criteria. Payment of liquidated damages:
1. If you notify before the 5th day before the start of the tour, pay 10% of the total travel expenses.
2. If you notify the 5th to 4th day before the start of the tour, pay 20% of the total travel expenses.
3. If you notify before the start of the tour from the 3rd to the 2nd day, pay 30% of the total travel expenses.
4. Pay 1 time before the start of the tour and pay 50% of the total travel expenses.
5. If you notify the tour start date and later, pay 100% of the total travel expenses.
Article 9 If the agreed departure time is delayed by more than 2 hours due to Party B's reasons, and Party A requests to terminate the contract to terminate the tour, Party B shall refund the unfinished journey fee and pay a 5% penalty for the tour fee. If the two parties are willing to continue to perform the contract, Party B shall bear the room and board and other necessary expenses incurred by Party A for delaying the travel itinerary, and pay a penalty of 5% of the travel expenses.
Article 10 If Party B disposes Party A during the journey, Party B shall bear the accommodation and other necessary expenses incurred by Party A during the period of disposal, refund the unfinished travel expenses and pay 30% of the travel expenses.
Article 11 If Party B transfers Party A to other travel agencies without the written consent of Party A, Party B shall pay Party A a penalty for damages according to 20% of the total group.
Article 12 Party B fails to submit the completed {Team Operation Plan Form” to Party A one day before the agreed departure date, or the content of the “Team Operation Plan Table” submitted does not conform to the first agreement of this contract. Party A has The right to cancel the contract.
Article 13 Due to the reasons of Party B, Party A shall be compressed for more than one hour at the scheduled tour time of a certain scenic spot. Party B shall refund the corresponding proportion of the tour fee of Party A according to the proportion of the reduced tour time to the agreed time of the scenic spot.
V. Other agreements
Article 14 With the consent of Party B, Party A may transfer its rights and obligations in this Travel Contract to a third party who has participated in the conditions of this travel, but Party B shall notify Party B before the agreed departure date.
Article 15 With the agreement of both parties A and B, the contents of this contract may be changed in writing. The increased travel expenses shall be borne by the party making the change, and Party B shall refund Party A the reduced travel expenses. If the loss is caused to the other party, the party making the change shall bear the loss.
Article 16 Party B recommends Party A to insure the travel personal accident insurance at its own expense.
Article 17 If Party A and Party B are unable to perform the contract due to force majeure, part or all of them shall be exempted from liability, unless otherwise provided by law.
If the travel expenses increase due to force majeure, the two parties shall share the expenses reasonably, and Party A shall bear __%, and Party B shall bear __%
Article 18 After Party A and Party B breach the contract, the other party shall take appropriate measures to prevent the loss from expanding. If no appropriate measures are taken to cause the loss to expand, no compensation shall be claimed for the expanded loss.
Article 20 When Party B entrusts other travel agencies to act as agents, it shall not be excused from the failure to directly collect Party A's expenses. Article 21 This contract shall be disputed in the performance, and the two parties shall settle the dispute through consultation; if the negotiation fails, Party A may complain to the competent travel law enforcement agency; both Party A and Party B may file a lawsuit with the court.
