I think I will correct these shortcomings in this internship and make greater progress. I have been working very hard in the past. This summer, I was fortunate enough to have been in the Public Prosecution Section of the County People's Procuratorate for more than a month. As an assistant inspector, I was involved in political and legal work. On the one hand, I hope that through practice, I have a perceptual and objective understanding of the theoretical knowledge I have learned during college, and on the other hand, I hope to improve my interpersonal skills and improve my cognitive ability to society. For more than a month, I did a lot of work with Mr. Shen who brought me with me: making review opinions, reviewing criminal suspects, writing public prosecution opinions and indictments, appearing in court to support public prosecution, etc., and I have learned a lot from myself:

I. Production review submission

The first thing that almost every student who comes to the internship department is to make a review opinion. This work is simple and simple, and it is complicated and complicated. The individual feels that the test is the patience and care of a person. It is simple because these cases were transferred from the public security organs. Some cumbersome work has already been done by them. It is complicated because the public security organs have to deal with many cases every day. There may be some negligence. At this time, it is necessary to test one. The prosecutor's care and patience, picking bones from the eggs.

The first case I participated in was the theft case. Listening to Mr. Shen said that the most common case they handled was the theft. The means of theft is now increasingly refurbished. I spent more than two hours reading the file. The main content of this file involved the criminal suspect's interrogation transcript, the victim's inquiry record and related material certificate, witness testimony, etc., and learned his motives in detail. The means of committing crimes, the amount involved, and the case of the public security organs, etc., can be considered to constitute theft, and then the operation on the ground, a template for theft was found, and a review opinion was made on the photo. I found that The most important of these is the identification of evidence. According to each of the evidences that have been finalized, the evidence has been verified and the evidence has been obtained legally and effectively. There is an objective correlation between the evidence that has been finalized and the facts that have been proven. The final purpose is to say that the evidence based on the case can lead to the only exclusive conclusion: the criminal suspect commits theft.

After more than an hour, a complete review submission was completed, and I took it to Teacher Shen. After Shen’s reading, I printed it out. I knew it was successful. There have been a lot of review opinions that I have produced this month. I can't remember how many of them are there. Anyway, there are all kinds of messy cases. Second, court support for public prosecution

During the period before the trial, the procuratorate will receive a notice of court appearance, and then the prosecutor will prepare for the court session, including the outline of the debate and the indictment. By the time of the trial, because there was no work permit, I did not appear in court as a public prosecutor to support the prosecution. Teacher Shen asked me to sit in the audience. I found the image of the prosecutor in the court to be even greater, especially when the prosecutor read out the indictment and issued a public prosecution. I found that after the case was handed over to the court, the prosecutor waited for the trial. In fact, before the court supported the public prosecution, the prosecutor must further examine the evidence and be familiar with the case. It should be said that when the case is filed, the prosecutor has a deep understanding of the case, but since the prosecution and the court are at a certain distance in time, and the prosecutors often undertake several different cases at the same time, it is easy to forget some key plots, so Further examination of the evidence of prosecution is required before the trial. At the same time, I will further familiarize myself with the case and analyze the defenses that the defendant and his defenders may propose so that the evidence can be used flexibly and freely in the trial, and the defendant and his defender can be refuted in a timely manner to deal with the unreasonable excuses of the defendants and to deal with various situations that have not been considered in advance. And to prove the crime, fully exercise the right to stand in court to support the public prosecution.

Third, the suspect is raised

In fact, during the internship, the most work I did was to go through the prosecutor to the detention center to try the suspect. Every time I go to the trial, I will learn a lot. I remember very clearly that for the first time, when I first entered, I was curious about everything in the detention center and kept watching. However, in the face of the criminal suspect, I was quietly sitting there and burying my head to make a transcript, and I dared not look straight into the eyes of the suspect. This was discovered by Teacher Shen. On the way back, Teacher Shen told me that the next time I come back, I must look up to the suspect. You are not an intern in front of the suspect. You It is a prosecutor. Later, I thought about it myself. Yes, the criminal suspect knows that I am an intern. If I always bow down the record, what would it be like to give him? ! Today, this "prosecutor" looks childish, and there is no majesty, which is the national staff! In front of the criminal suspect, I represent the prosecutor, representing the image of the entire procuratorate, and must let him feel the majesty of the law. Therefore, in the course of the subsequent trial, I bravely looked directly at them, and sometimes I also asked a few words and found that this feeling is very good.

In the process, I followed a lot of prosecutors to review, I almost became a frequent visitor to the detention center, each prosecutor's method of interrogation is different, during this period also learned a lot of interrogation skills. I clearly remember the criminal suspect of a contract fraud. In the investigation stage of the public security organs, the attitude was very tough. He only admitted that he was involved in the case, but Zhang prosecutors broke through his psychological defense step by step, and finally he confessed to him. The criminal act also reported the crimes of other people and strived for meritorious service. The one sentence that impressed me the most is that although we have different legal status, we are all equal in personality. I think maybe this is the sentence that really touched him so that he can truthfully explain his criminal behavior. In front of him, I really understood that the road is one foot high and the word is high.

The impression that followed the section chief gave me a deep impression. The first sentence he made during the trial was that you should explain it well. I found that they attach great importance to the criminal suspect's guilty attitude. It is easy to see from a case he has handled. One robbery case, two suspects, one of them is very good, the other is tough, and nothing is explained. In the case of zero confession, the final attitude was judged for two and a half years. The attitude was strong and sentenced to seven years. Now the seven-year-old is regretted on the farm. Because the materials sent by the procuratorate to the court have a sentencing suggestion, the court basically sent a sentence in this magnitude. Therefore, a clever criminal should be confessed at this time, and he must turn it over to the court to go over it. At that time, he gave the prosecutor a surprise, and if he was lucky, his retraction might be accepted by the judge!

Drafting the indictment

After completing the previous stages, it was time to draft the indictment. Teacher Shen believed me very much and often let me draft it. I want to know that these are to be read on behalf of the procuratorate and are to be delivered to the suspect. , the victim and other related personnel, can imagine how strict its format, language and so on. As with the production review comments, I still found a template to refer to, but I still carefully consider each term, for fear of making mistakes. After the final completion, I will give it to Mr. Shen to amend it. I will print it out if I haven’t changed it very much. Then I will send it to the section chief to sign and seal it, and finally get it back for the manuscript. Since the internal office was busy that day, then they asked me to send the case to the court court. I called the driver and went to the court. Five, postscript

A month's time passed quickly. I don't want to say how much I learned during this period, but I did come into contact with many things I never thought of. The work of the Public Prosecution Section of the Procuratorate is a matter of time, and it is not enough to rely on this one month alone. During the internship, my textbook knowledge was consolidated and my ability to solve problems was also exercised.
