Article 5 In any of the following circumstances, it shall be regarded as a work error or a law enforcement fault case, and a case review shall be conducted:

The court heard the administrative litigation case and sentenced the bureau to lose the case;

If the original punishment decision is revoked by administrative reconsideration or the specific administrative act is confirmed to be illegal;

Reports, accusations or complaints of citizens, legal persons or other organizations are verified;

Others should be reviewed.

Article 6: Determination of the work error and the person responsible for law enforcement fault:

If the contractor’s intentional negligence causes work errors and law enforcement errors, the undertaker shall bear the responsibility;

If the contractor causes work errors and law enforcement faults after approval, the approver shall bear the responsibility;

If the work is wrong or the law enforcement is wrong due to the collective research decision of the meeting, the unit shall bear the responsibility;

Where the person in charge instructs or instructs the undertaker to handle the law illegally or illegally handle the case, the responsible person shall bear the responsibility;

Article 7 The handling of work errors and law enforcement faults shall be based on the cause, nature, extent, consequences of the error and the wrong attitude of the responsible person to decide whether to give the following treatment:

Administrative sanctions;

Transfer from work;

compensation;

Postponed promotion and promotion;

Cancel the selection of advanced qualifications;

Reduce or stop the bonus;

The types of the above treatments can be selected individually or in combination.

Article 8 In the course of work and administrative law enforcement, staff members and administrative law enforcement personnel shall have one of the following circumstances, and shall not apply for accountability for work errors and law enforcement faults:

Difficult cases that are difficult to identify in administrative law enforcement practice;

The legal provisions are not clear or the judicial interpretation is inconsistent;

An error occurs because of unforeseen or irresistible reasons;

Execute the superior command;

In accordance with the provisions of the case cooperation, assist in handling the case;

Responsible persons who have made work mistakes and law enforcement faults actively correct mistakes and have not caused losses to citizens, legal persons and other organizations.

Article 9 Where laws, regulations and rules clearly stipulate wrongful or fault liability, they shall be implemented in accordance with the provisions.

Article 10: General work procedures for work errors and law enforcement errors

After receiving the complaints, reports, accusations, reports, judgments and reconsideration decisions, the bureau will decide whether to file the case;

The investigation team that decides to file a case with not less than 2 persons will investigate the case and propose investigations and treatments;

The Leading Group for Accountability for Work Errors made a handling opinion based on the investigation.

Article 11 If a person responsible for work errors or law enforcement faults is dissatisfied with the decision, he may apply for review or file a complaint, and the decision during the review and appeal period shall not be suspended.
