Interim Measures for Social Security of Disabled Persons in the Town


Chapter 1 General

Article 1 In order to protect the legitimate rights and interests of persons with disabilities, develop the cause of the disabled, solve the special difficulties and needs of the disabled, ensure that the disabled fully participate in social life on an equal footing, and share the material and cultural achievements of the society. The Law and the Measures for the Implementation of the Protection of Disabled Persons in Jiangsu Province are formulated in conjunction with the actual conditions of the town.
Article 2 The object of this measure is the disabled and disabled families who have permanent residence in the town and hold the "People's Republic of China Disabled Person's License".
Article 3 Establish a social security fund account for disabled persons in the town, and at the same time formulate regulations on the use of social security funds for disabled persons in the town. The amount of social security funds for disabled people in each year is raised in principle according to the total population of the town and the standard of 5 yuan per capita. The sources of fund raising are town financial subsidies, municipal medical assistance funds, welfare enterprises tax reduction and exemption funds, civil relief funds, employment security funds, and social donations.
Article 4 The funds required for these Measures shall be included in the account of the Social Security Fund for Disabled Persons in the town.

Chapter II Life Security

Article 5 For persons with disabilities who have no ability to work, are unable to support their dependents, and have no source of income, they shall apply for it, discuss and agree with the villagers' group meeting, review by the village committee, report to the town government for approval, and give priority to the five guarantees. Or decentralized support. And in accordance with the "Regulations on Rural Five Guarantees Support Work" to implement various safeguard measures.
Article 6 For disabled families who meet the minimum living security standards, the civil affairs department shall implement the minimum living allowance and increase the minimum living standard for disabled persons in their families by 10%.
For severe adult disabled persons who rely on their parents, they can be listed separately because of their parents’ frail difficulties, and they should be included in the minimum living allowance.
Rural disabled persons who have not arranged for work are directly listed as urban minimum living allowances.
The various benefits received by persons with disabilities in accordance with these Measures shall not be included in the income of the family who enjoy the minimum living security.
Article 7 Persons with disabilities over 70 years of age may enjoy a living allowance of 10 yuan per month with the "People's Republic of China Disabled Person's License".
Article 8 A monthly subsidy of 20 yuan per month shall be imposed on persons with disabilities who meet one of the following conditions;
Disabled persons with more than 2 disabled persons in the family members;
Difficulties of no parental support or child support?html> /> --> 1.5% of the total number of workers to enroll qualified persons to enter the factory.
Article 20 The training of vocational skills for the disabled shall be carried out in various forms such as holding training courses, purchasing training results, and teachers and apprentices. The disabled persons with difficulties in living shall be given appropriate living allowances during the training period, and some or all training fees shall be waived.
Article 21 Actively support and encourage individuals with disabilities to participate in employment and self-employment, give priority to the business license for disabled persons, and reduce the exemption of industrial and commercial registration fees, business management fees, trade market management fees and economic contract model texts.

Chapter VI Education Guarantee

Article 22 In the compulsory education stage, the miscellaneous expenses of students with disabilities shall be fully reduced or exempted by the school.
Article 23 The children of the disabled families with disabilities and the disabled students of the minimum living allowance shall be free of charge from the school for tuition, miscellaneous fees and accommodation expenses during the compulsory education period. The tuition fees for the above-mentioned subjects in public schools at the non-compulsory education stage shall be reduced by 50% or free of charge at the discretion of the higher education standards.
Article 24: A one-off subsidy of 1,000 yuan for students with poverty and disability who are enrolled in undergraduate studies, a one-time subsidy of XX yuan for children with disabilities or children with disabilities who are under the minimum living allowance; and a one-time subsidy of 800 yuan for students with poverty and disability who are enrolled in college. One-time subsidy of 1,500 yuan for disabled students or children with disabilities who are subsistence allowances; 500 yuan for one-off subsidies for students with disabilities who are enrolled in technical secondary schools, and 1,000 yuan for children with disabilities or children with disabilities who are under the minimum guarantee;

Chapter VII Social Insurance

Article 25 All persons with disabilities who are eligible for medical treatment for major illnesses and those who meet the provisions of Articles 1-6 of Chapter VIII of Chapter 2 shall be all settled by the town.
Article 26 All the disabled employees in enterprises, institutions and welfare enterprises shall be subject to social endowment insurance according to law. Persons with disabilities who engage in individual labor have not yet participated in social endowment insurance, and should actively participate in social endowment insurance as required.

Chapter VIII Social Assistance

Article 27: Adopting measures such as “Party Cadre Support”, “Departmental Poverty Alleviation”, and “Volunteer Assistance for Disabled Persons” to carry out social mutual assistance activities, help improve the living conditions of low-income disabled families, and ensure the service and relief of special disabled people. Family difficulties caused by severely disabled and elderly people raising dependent children.
Make full use of festivals such as the Spring Festival and the National Helping the Disabled Day to carry out various forms of disability activities.
Article 28: Legal aid for all persons with disabilities and families with disabilities:
Where the disabled person applies for recourse to alimony, labor remuneration, work injury compensation and pensions and other legal services, the town legal department shall give priority to providing high-quality and efficient legal aid to effectively protect the legitimate rights and interests of the disabled.
Provide legal advice free of charge to people with financial difficulties, and write general legal texts for free.

Chapter IX Supplementary Blonde Program

Article 29 Persons with disabilities who meet the requirements of Articles 7 and 8 of Chapter 2 of these Measures shall, when applying for the subsidy, submit a written application to the village committee by their own or relatives with their permanent residence book and disability certificate. Fill out the disability assistance application form and issue relevant certification materials.
Article 30 The village committee shall review the application and supporting materials provided by the applicant, and sign the audit opinion and report it to the town disabled person's association and the civil affairs department for examination and approval.
Article 31 For persons with disabilities who are granted regular hardship assistance, the Municipal Disabled Persons' Federation and the civil affairs department shall issue the subsidy amount in time to receive the subsidy, and the income object shall receive the subsidy from the civil affairs department on the basis of the “subsidy certificate” issued. The subsidies for the regular subsidies in accordance with Articles 7 and 8 of Chapter 2 and the subsidies for the special disabled persons who have been included in the subsistence allowances shall be paid quarterly; the issuance of the special temporary hardship grants shall be issued after approval of relevant procedures.
Article 32 The collection of periodic subsidies for disabled persons and temporary special hardship grants must be collected by the applicant himself. In case of special circumstances, if the applicant cannot be present to receive the subsidy, the civil affairs department shall send the subsidy to the applicant and perform the acceptance procedures; if the applicant entrusts others to take over the case, a copy of the ID card of the representative shall be attached. Chapter X Management and Supervision Article 33 The Municipal Disabled Persons' Federation and the civil affairs department shall, in conjunction with the village committee, implement dynamic management of the regular subsidies for impoverished persons with disabilities, conduct visits and verifications of different subjects each year, and change according to income and rehabilitation. , timely stop and reduce subsidies.
Article 34 The distribution of regular relief funds for impoverished persons with disabilities shall be subject to public notice. The list of recipients of subsidies, the specific difficulties encountered, and the amount of relief subsidies shall be announced in the village committees and accepted by the public.
Article 35 At the end of each year, the town government organizes the supervision and auditing departments to audit the collection and use of social security funds for disabled persons, and publish the results of the audit and accept social supervision.
Article 36 The town government is seriously responsible for the work, and is eager to reward the staff of the disabled and disabled families; to dismiss the incompetent job; to make mistakes in work, to neglect their duties, to engage in malpractice or to embezzle or embezzle The social security funds shall be seriously investigated and punished, and reported to the relevant authorities for accountability according to law.

Chapter XI Supplementary Provisions

Article 37 The Municipal Disabled Persons' Federation is responsible for the interpretation of these Measures.
Article 38 These Measures shall come into force on January 1, 2002.
