Article 2 These measures shall be applied to the assessment of the safety production behavior of the construction enterprise management personnel who hold the certificate of safety production assessment of the construction enterprise management personnel and engage in construction engineering activities within the administrative area of ​​this Municipality.
Article 3 If the project is subject to general contracting, the safety production behavior of the management personnel of the general contractor shall be assessed and scored; if the general contracting is not implemented, the safety production behavior of all construction enterprise management personnel participating in the construction shall be assessed and scored. The ic card management shall be implemented for the person in charge of the construction enterprise project; the main responsible person and the full-time safety production management personnel shall gradually implement the ic card management.
Article 4 The principal person in charge of a construction enterprise referred to in these Measures refers to the personnel who are fully responsible for the daily production and operation activities and safety production of the enterprise and have the decision-making power of production and operation, including the legal representative and manager of the enterprise and the safety production related to the enterprise. Deputy manager, chief engineer, etc.
The person in charge of the construction enterprise project refers to the person in charge of the project management enterprise project manager qualification certificate or the construction engineer qualification certificate, authorized by the main responsible person of the enterprise, and responsible for the construction project management.
The full-time safety production management personnel of a construction enterprise refers to the personnel who are engaged in safety production management work in the enterprise, including the person in charge of the enterprise safety production management organization and its staff and the full-time safety production management personnel on the construction site.
Article 5 The administrative department in charge of construction of Suzhou Municipality is the comprehensive administrative department responsible for the management of the safety production behavior assessment of the management personnel of construction enterprises in the city.
The Suzhou Construction Industry Safety Supervision Station is entrusted by the Suzhou Municipal Construction Administrative Department to carry out the assessment scores and daily supervision of the safety production behavior of the construction enterprises in Suzhou Central City.
The county-level city and district construction administrative departments shall be responsible for the assessment and management of the safety production behavior of the construction enterprise management personnel within their respective jurisdictions. The county-level city and district construction administrative departments may entrust their own construction engineering safety supervision agencies to implement the assessment scores and daily supervision of the safety production behavior of the construction enterprise management personnel.
Article 6 The assessment of safety production behavior shall take the form of scoring, with the natural year as the scoring cycle, with a full score of 10 points.
Article 7 When carrying out daily supervision and inspection and prior notice inspection, the construction safety supervision agency shall conduct an assessment of the safety production behavior of the construction enterprise management personnel, and shall score points when it meets the requirements of the score. When the governments at all levels, relevant departments, and construction administrative departments organize relevant inspections, they shall notify the local construction engineering safety supervision agencies to implement the assessment scores when they need to assess the safety production behavior of the construction enterprise management personnel.
Article 8 When assessing the safety production behavior of construction enterprise management personnel, the staff of the construction safety supervision agency shall conscientiously implement the safety production of the management personnel of Suzhou construction enterprises in order to promote the timely rectification of enterprises and ensure the full production. "Standards for the assessment of behavioral assessment", if it is necessary to score, it should fill out the "Approval Form for the Examination and Approval of the Safety Production Behavior of Managers of Construction Enterprises in Suzhou City", write clearly the reasons and scores of the scores, and report to the local construction safety supervision agency. The main responsible person can approve the consent before it can take effect. The construction construction enterprise management personnel corresponding to the scores shall notify the person to be scored within 3 working days, and shall produce the “Record of the Safety Production Behavior Assessment of the Management Personnel of Suzhou Construction Enterprises”. The signature of the person to be scored is confirmed by the signature. The "copy notice" is in triplicate, one is filed by the construction safety supervision agency, one is handed over to the scorer, and one is submitted to the construction company.
Article 9 If the management personnel of a construction enterprise have two or more illegal production safety activities at a time, they shall separately calculate and accumulate points.
Article 10 If the score reaches the full value within an assessment score cycle, the assessment of safety production behavior is unqualified.
Article 11 If the score value of the score is not up to the full score during the assessment score cycle, the score of the score will be cancelled when the score cycle expires, and will not be transferred to the next assessment score cycle.
Article 12 The construction construction enterprise management personnel who fail to pass the assessment of safety production behavior by the construction administrative departments of various localities shall be ordered to rectify within a time limit and accept compulsory training and examinations for safe production.
Article 13 The compulsory training and examinations shall be organized by the construction administrative department of Suzhou City. The contents include: laws and regulations on the safe production of construction projects, normative standards for construction safety, relevant provisions for civilized construction of construction projects, and relevant knowledge on construction safety. Wait, the training time is no less than 20 class hours.
Article 14 If the compulsory training examination for the management personnel of a construction enterprise is unqualified, it is allowed to apply for one re-test, and if the re-examination is still unqualified, it is recommended that the issuing authority revoke its certificate of conformity.
Article 15 The management personnel of a construction enterprise shall, within the validity period of the certificate of conformity, obtain the full score of the scores of the two times, and recommend that the issuing authority revoke its certificate of conformity.
Article 16 The county/level municipal and district construction administrative departments shall fill out the "Summary Table of Unqualified Personnel for Safety Production Behavior Assessment of Suzhou Construction Enterprises" by the 5th of the first month of each quarter, and the safety production behavior of the last quarter. The list of management personnel of construction enterprises with an accumulated score of 10 points shall be submitted to the Suzhou Construction Bureau and published on the relevant website of the locality. The Suzhou Construction Bureau will publish the unqualified assessment of safety production behavior once a quarter on the credit file of the construction enterprise enterprise credit file and the construction enterprise management personnel credit file column of the Suzhou Engineering Construction Network.
Article 17 If a management personnel of a construction enterprise has any objection to the assessment score, it may report it to the local construction administrative department within 3 working days. If there is any objection to the decision of the local construction administrative department, it may be reported to the construction administrative department of Suzhou City. After verification, the results of the assessment scores are indeed improper. The construction administrative department shall order the construction safety supervision agency to change or cancel the corresponding scores.
Article 18 When the construction safety supervision organization conducts an assessment score for the safety management personnel of a construction enterprise, the safety supervision agency shall have no less than two staff members. The staff of the safety supervision agency shall have dereliction of duty, abuse of power, and fraudulent practices in the assessment and scoring work, and shall be dealt with according to relevant regulations according to the seriousness of the circumstances.
Article 19 Where the safety behavior of the management personnel of a construction enterprise involves illegality, it shall be punished in accordance with the provisions of relevant laws, regulations and rules. If it constitutes a crime, criminal responsibility shall be investigated in accordance with the relevant provisions of the Criminal Law.
Article 20 These Measures shall come into force on January 1, XX.
