In the criminal cases accepted by our hospital in the past two years, there has been a criminal group that should not have appeared: college students. Why do the princes of the heavens who live in the ivory tower and receive much attention from the society go on the road of crime, what problems should the contractor pay attention to when handling the case, and how can the crime of college students be reduced? With these question marks, the author conducted an investigation and analysis of the crimes committed by college students.
First, the characteristics of college students' crimes: The crimes involved in college students' crimes are very simple. From the current statistics, only the two crimes of theft and intentional injury are involved. The author has subjectively considered that there should be no high IQ crimes before the investigation; The ratio of male to female is 7:1. Male college students are mainly suspected of intentional assault. Female college students are all suspected of theft.
The amount involved: the targets of college students suspected of theft are all mobile personal items, such as mobile phones, credit cards, walkmans, etc., and the amount involved is relatively small, most of them are around 1,000 yuan, only one case involved The amount is 7,000 yuan; and the crime of intentional assault is the highest "slightly hurt", the vast majority of minor injuries;
Infringement of Objects: Most of the objects of college students' crimes are classmates. The more familiar people are, the more likely they are to be invaded, just like dormitory students. There are only two cases in which people who do not know are infringed upon;
Mandatory measures: College students commit crimes with bail pending trial as the main compulsory measure, and the insured person can generally abide by the law, and only one case changes the compulsory measures due to the subpoena;
Processing results: penalties are generally lighter. Non-prosecution cases accounted for 15%, and the rest were sentenced to imprisonment for up to three years; the simple procedure was generally applied to the trial procedure.
Personnel composition: Among the college students involved, the colleges of private colleges and universities, the colleges of adult education colleges and colleges, and the specialties of public institutions of higher learning. In the case collected by the author, there has not been a case of student crime in the university department of public higher education institutions.
Age structure: Students in the first and second grades of the university and the first year of the junior college. There is no case of crimes committed by third- and fourth-grade students in the university department.
Household registration characteristics: University students who come to Beijing to study in other places. There are only two cases of crimes committed by local students.
Subjective intention of crime: These college students are subjectively vicious and have no resentment. All of them can truthfully confess their crimes, and the confession is very stable. From the investigation stage to the trial stage, there is no reversal.
Second, the analysis of college students' crimes
1. The legal awareness of college students is generally indifferent.
As far as China's current education system is concerned, the focus is still on academic education, not on quality education. Although the situation of calling for such "heavy academic qualifications and light weights" has changed, it is still far from achieving the ideal situation. There is no content about legal education in Chinese small textbooks. Even in universities, it is only a compulsory course "legal basis theory" in the first year of university. Under this kind of education system, students and parents only pay attention to scores, while ignoring elementary education, the concept of law-abiding is very indifferent.
2. The impact of the social environment and the school's small environment.
Although college students are already adults in the legal sense, most of them belong to school since childhood and rarely touch the society. Their psychological state has not yet reached the maturity of adults, and the influence of the surrounding environment cannot be ignored.
From the perspective of the social environment, the students who have been exposed to the most from childhood are television and magazines. Some bad film and television works and magazines from Hong Kong and Taiwan have impacted students' outlook on life and morality visually and spiritually, imperceptibly affecting students' words and deeds. Some students who have been immersed in the long-term immersion in the “high-pressure management” of the middle school have entered the more liberal university, and they are relaxed and may go astray. Although most of the criminal college students regretted after the incident, they have not helped.
From the perspective of the school environment, private universities account for a large proportion of the schools affiliated to criminal college students, and the second is the Adult Education Institute. It is undeniable that some private universities have made positive contributions to attracting students and low-scoring students. The Adult Education Institute also provides opportunities for those who wish to continue their studies in the society, but both focus on economic benefits and implement loose management. The school-running model has also laid a hidden danger for local social security, which is not conducive to the growth of college students.
3, the psychological reasons of criminal college students analysis of luck, impulsive psychology. Among the crimes committed by college students, there are almost no crimes committed, most of which are impulsive crimes, that is, temporary intentions. College students who commit theft have a lot of greed and greed. Driven by luck, the ghosts make the other people's articles "hands-on". Only one case is stealing out of curiosity and stimulating psychology. Most college students who commit intentional assault are hot-headed and impulsive. After the injury, I regretted it.
Affected by psychological imbalance and sense of loss. In the case collected by the author, the subjects of the crime are all students in the first and second grades of the university, especially in the field. Foreign university students first came to Beijing to study, away from home and relatives, the surrounding environment changed a lot, the psychology is in the transition period of students' transition to adults; coupled with their own shyness, the mind is prone to imbalance or embarrassment, and loneliness is also born. Students with poor self-control ability or lazy thoughts can easily go astray if no one is enlightened.
4. The "fuse" analysis that induces college students' crimes induces the direct cause of college students' crimes, that is, the fuse that induces crimes is that the victim's own prevention consciousness is not strong, and it is a good opportunity for the students with bad thoughts. In the case of theft, most of the stolen items were placed by the victim in a place exposed to the public line of sight, causing a poorly ill college student to take the lead; in the case of intentional injury, the victim lacked a sense of prevention for the violent college students, and did not know Avoid it at the right time, and retreat to the result, resulting in unnecessary harm.
