Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Teacher Law of the People's Republic of China in order to improve the quality of teachers and strengthen the construction of teachers.
Article 2 Chinese citizens who specialize in education and teaching at all levels of schools and other educational institutions shall obtain teacher qualifications in accordance with the law.
Article 3 xx The education administrative department is in charge of the national teacher qualification work.
Chapter II Classification and Application of Teacher Qualifications Article 4 Teacher qualifications are divided into:
Kindergarten teacher qualifications;
National qualifications for teachers;
Junior high school teachers and junior vocational school cultural and professional teacher qualifications;
Senior secondary school teacher qualification;
Secondary professional schools, technical schools, vocational high school cultural courses, professional class teachers qualifications;
Secondary professional school, technical school, vocational high school internship teacher qualification;
Teacher qualifications in higher education institutions.
The teacher qualifications for adult education are determined according to the level of adult education and the categories are determined in accordance with the provisions of the preceding paragraph.
Article 5 Citizens who have obtained the qualifications of teachers may serve as teachers in various schools and other educational institutions at the same level and below; however, citizens who have obtained the qualifications of internship instructors in secondary vocational schools can only be in secondary specialized schools and technical schools. Vocational high school or junior vocational school as an internship instructor.
Senior high school teacher qualifications and secondary vocational school teacher qualifications are mutually exclusive.
Chapter III Conditions for Teacher Qualifications Article 6 The qualifications for teachers shall be implemented in accordance with the provisions of Article 10, paragraph 2 of the Teacher Law. The “capable of teaching and teaching” shall include the physical conditions for engaging in education and teaching in accordance with state regulations.
Article 7 The corresponding academic qualifications required to obtain the qualifications of teachers shall be implemented in accordance with the provisions of Article 11 of the Teacher Law.
To obtain the qualifications of an internship instructor in a secondary vocational school, it shall have the qualifications prescribed by the xx education administrative department, and shall have a professional technical position equal to or above the assistant engineer or a technical level of the intermediate or above worker.
Chapter IV Teacher Qualification Examination Article 8 Citizens who do not have the qualifications of teachers as stipulated in the Teacher Law shall apply for the teacher qualification examinations held or approved by the state.
Article 9 The subject, standard and examination outline of the teacher qualification examination shall be examined and approved by the xx education administrative department.
The preparation of the teacher qualification examination papers, the examination work and the issuance of test scores, belong to the kindergarten, national primary, junior high school, high school, secondary vocational school teacher qualification examination and secondary vocational school internship teacher qualification examination, from the county level or above. The administrative department of education of the people's government shall organize the implementation; the examinations for teachers' qualifications in higher education institutions shall be organized and implemented by the xx education administrative department or the higher education institutions entrusted by the education administrative department of the people's government of the autonomous region or municipality directly under the Central Government.
Article 10 The teacher qualification examinations for kindergartens, elementary schools, junior high schools, high schools, secondary vocational schools and the qualification examinations for secondary vocational schools are conducted once a year.
Participate in the teacher qualification examination listed in the preceding paragraph, and pass all the examination subjects to the teacher qualification examination certificate; the subjects that fail the examination in the current year may be retaken in the next year; if one or more subjects fail to pass the supplementary examination, they shall Retake the exam for all exam subjects.
Article 11 The qualification examination for colleges and universities shall be held as needed.
Applicants for the qualification examination for colleges and universities should have expertise and be recommended by two professors or associate professors.
Chapter V Determination of Teacher Qualifications Article 12 Citizens who have the qualifications prescribed by the Teacher Law or who have passed the teacher qualification examination may apply for the qualification of their teachers in accordance with the provisions of these Regulations.
Article 13 The qualifications of kindergarten, elementary school and junior high school teachers shall be determined by the education administrative department of the county-level people's government where the applicant's household registration is located or where the applicant teaches the school. The qualification of the senior middle school teacher shall be reported to the higher education administrative department for approval after being examined by the education administrative department of the county-level people's government where the applicant's household registration is located or where the applicant teaches the school. The qualifications of teachers in secondary vocational schools and the qualifications of internship instructors in secondary vocational schools shall be examined by the education administrative department of the county-level people's government where the applicant's household registration is located or where the applicant is teaching the school, and reported to the higher education administrative department for identification or organization of relevant departments.
The higher education institutions entrusted by the administrative department of education or the education administrative department of the people's government of the autonomous region or municipality directly under the Central Government shall be responsible for determining the qualifications of the teachers who are employed in the school and the teachers of the higher schools.
Qualifications of higher education institutions who are not employed by the xx education administrative department or the higher education institutions entrusted by the education administrative department of the people's government of the autonomous region or municipality directly under the central government, and the qualifications of the higher education institutions of the school, shall be determined by the administrative department of education or by the location of the school. The administrative department of education of the people's government of the autonomous region and municipality directly under the Central Government is recognized.
Article 14: To determine the qualification of a teacher, the applicant shall apply.
The administrative department of education and the entrusted institutions of higher learning receive an application for qualification of teachers each spring and fall. The specific acceptance period shall be prescribed by the education administrative department or the entrusted higher education institution and published in an appropriate form. The applicant shall file an application within the prescribed acceptance period.
Article 15 In applying for the qualification of a teacher, the application form for teacher qualification shall be submitted and the following certificates or materials shall be submitted:
personal I.D;
Certificate of academic qualification or teacher qualification examination;
Medical examination certificate issued by the education administrative department or the hospital designated by the entrusted institution of higher learning;
The identification and certification materials of the street office, the township people's government or the work unit, and the school that graduated from the household registration, for their ideological and moral character, and whether or not there is a criminal record.
If the certificate or materials submitted by the applicant are incomplete, the education administrative department or the entrusted higher education institution shall promptly notify the applicant to complete the application before the termination of the acceptance period.
The application form for teacher qualification is standardized by the xx education administrative department.

Article 16 The administrative department of education or the entrusted institutions of higher learning shall, after receiving the application for recognition of the qualifications of the citizens, review the conditions of the applicants; if the conditions for the determination are met, they shall be 30 on the date of termination of the acceptance period. The corresponding teacher qualification certificate shall be issued within the day; if the conditions for non-conformity are met, the conclusion shall be notified to the person within 30 days from the date of termination of the acceptance period.
Citizens who have graduated from non-teacher colleges or who have passed the qualification examination for teachers shall apply for recognition of kindergarten, national or other teacher qualifications, and shall conduct interviews and test lectures to examine their educational and teaching abilities; according to actual conditions and needs, the education administration department or the entrusted Institutions of higher learning can ask applicants to supplement courses in education, psychology, etc.
Teacher qualifications are applied nationwide. The teacher qualification certificate is uniformly printed by the xx education administrative department.
Article 17 If a citizen who has obtained the qualification of a teacher intends to obtain the qualifications of a higher-level school or other educational institution, he shall pass the corresponding teacher qualification examination or obtain the corresponding academic qualifications stipulated by the teacher law, and in accordance with the provisions of this chapter, after passing the certification, The corresponding teacher qualification certificate is issued by the education administration department or the entrusted higher education institution.
Chapter VI Penalty Article 18 If the teacher's qualification is lost in accordance with the provisions of Article 14 of the Teacher's Law, the teacher's qualifications shall not be re-acquired, and the teacher's qualification certificate shall be collected by the education administrative department of the people's government at or above the county level.
Article 19 In any of the following circumstances, the education administrative department of the people's government at or above the county level shall revoke its teacher qualifications:
Falsify and defraud the teacher;
Bad conduct, insulting students, and affecting bad.
If the qualification of the teacher is revoked, the teacher qualification shall not be re-applied within 5 years from the date of cancellation, and the teacher qualification certificate shall be collected by the education administrative department of the people's government at or above the county level.
Article 20 If there is cheating in the teacher qualification examination, the test results will be invalid, and the teacher qualification examination may not be taken again within 3 years.
Article 21 If the proficiency testers and other relevant personnel of the teacher qualification examination violate the confidentiality regulations and cause the test questions, reference answers and scoring standards to be leaked, the legal responsibility shall be investigated according to law.
Article 22 In the case of teacher qualification examination, negligence of duty, malpractice for personal gains, and loss of teacher qualification work shall be given administrative sanctions by the administrative department of education according to law; if a crime is constituted, criminal responsibility shall be investigated according to law.
Chapter VII Supplementary Provisions Article 23 These Regulations shall come into force as of the date of promulgation.
