Personnel lease agreement

Party B shall entrust Party A to provide labor services due to production needs. According to the Labor Law and the _________ Provincial Labor Market Management Regulations and other relevant labor security laws and regulations, both parties have reached the following contract:

Second, the rental output content
1. Party A shall, in accordance with the needs of Party B, recommend qualified employees to be used by Party B.
2. The personnel exported by Party A to Party B are the employees of Party A. Party A signs the labor contract with the rented employee, pays the wages, and handles various social insurances for it, and pays social insurance premiums and provident fund in full.
Third, labor service settlement
1. The composition of labor costs: leasing employee labor costs, social insurance premiums, provident fund and export labor service fees.
2. Labor costs of each project standard:
Rental employee labor costs _________ yuan / month to _________ yuan / month;
Social insurance _________ yuan / month;
Party A shall charge the output labor service fee according to the monthly employee's _________ yuan per person;
Provident fund _________ yuan / month; where: unit _________ yuan / month; individual _________ yuan / month.
3. Settlement time and method: Party B will pay the full amount from the bank to the Party A account before the _________ day of the month, and provide a billing list for each fee. The wages of the hired employees shall be paid by Party A before the _________ day of each month.
4. Party B shall pay the labor service fee and related expenses of Party A, and Party A shall issue an invoice for the formal labor service fee.
4. Party A’s responsibilities, rights and obligations
1. Party A shall, in accordance with Party B's employment requirements, provide suitable candidates for Party B's assessment, and Party B shall determine the employment targets determined by Party B. Party A shall handle the labor contract signing and social insurance payment procedures within _________ days.
2. Party A shall issue the labor service fee for the rental staff and pay the social insurance premium on the _________ day of each month.
3. Party A shall be responsible for reporting to the labor department for the work injury and birth of the leased employee.
4. If Party B’s rented employees are dismissed, Party A shall go through the formalities of retreating.
5. Party A may take a variety of forms to understand the situation of Party B's use of leased employees. Party B shall cooperate; Party A shall cooperate with Party B to do the management of the leased employees and assist Party B's education and lease employees to abide by national laws and regulations and the rules and regulations formulated by Party B according to law. .
6. If Party B violates this Agreement, defaults on all kinds of funds payable, and violates labor policies and regulations to damage the legitimate rights and interests of the leased employees, Party A may, in accordance with the law, negotiate with Party B, requesting Party B to continue to perform its obligations and claim against Party B according to the actual losses.
5. Party B’s responsibilities, rights and obligations
1. Party B shall use the leased employee to sign the “Agreement on Appointment” to clarify the labor content and requirements and labor service standards.
2. Party B shall provide basic labor conditions and post labor protection for the leased employees, and conduct safety education for the leased employees. If the rented employee has a work-related accident or a third-party injury caused by work, Party B shall cooperate with Party A to deal with it, and the relevant treatment measures shall be implemented in accordance with relevant state regulations.
3. Party B shall pay the labor costs to Party A in full and on time in accordance with the provisions of this Agreement, and shall not default.
4. Party B has the right to assess and reward the leased employees in accordance with the rules and regulations. If the leased employees fail the assessment, they terminate the labor relations and return to Party A. If Party B causes losses to Party B, Party B has the right to demand compensation.
5. Party B has the right to inquire about the payment of the labor expenses of the leased employees and the payment of various social insurances. If Party A has intercepted the labor costs and social insurance premiums of the leased employees, Party B may, in accordance with the law, negotiate with Party A to request correction, thus causing Party B’s loss. Party A shall give Party B compensation.
6. Labor Dispute Handling and labor disputes arising out of leased employees, both parties have the right to initiate arbitration and prosecution.
Seven other matters
1. In the course of the performance of this contract, if the relevant contents of the contract are inconsistent with the newly issued laws, regulations and labor security policies of the State, it shall be implemented in accordance with the new regulations.
2. Matters not covered in this contract shall be agreed in writing by both parties.
3. This contract is in duplicate, and both parties will take effect after signing and stamping, and both parties will be responsible for each.
