Rental estate agency agreement


This form is prescribed by the Estate Agents Authority in accordance with the Estate Agents Ordinance.

For general notes, please refer to the same numbered notes in Schedule 4 to this Agreement. Any reference in this Agreement to a Schedule to this Agreement is also referred to immediately.

1. Appointment of the agent and the validity of this agreement

I/We, ________________ are now appointing ______________ as my/our exclusive/non-exclusive agent in accordance with the terms of this Agreement and subject to those terms, for the purpose of selling ______________. [Note that the agency relationship between the agent and the owner is a unilateral agent/bilateral agent/agent relationship that may represent the two parties;

In the case of a bilateral agency relationship, the agent shall, as soon as practicable, disclose in writing to the owner the amount or rate of commission that the agent will charge the tenant;

In the case of an agent relationship that may represent the parties, the agent shall, as soon as practicable after the establishment of the bilateral agency relationship, disclose in writing to the owner the agency relationship and the amount or rate charged by the agent to the tenant. And the agent is also required to perform the duties set out in Schedule 1 to this Agreement in addition to the obligations of the Agency or any enactment.

3. Place the rent [Note: The owner has not authorized the agent to accept any offer on behalf of the owner. The rental is only available for listing and advertising. ]

The rent for the rent is HK$______________ per month, including/excluding rates and management fees. The rent for rent can only be changed under the written instructions of the owner and such instructions will form part of this Agreement.

4. Commission

The provisions of this Agreement applicable to commissions payable by the Owner to the Agent are set out in Schedules 2 and 4 to this Agreement.

5. Property information

The agent is required to provide the owner with a rental information form prescribed by the Estate Agents General Regulations and completed and signed by the agent.

6. Inspection of the property owner agrees to allow the agent/tenant to view the property at the time agreed by both parties.

7. Distribution and release

The owner authorizes the agent to release the property distribution and hand over the information provided by the landlord about the landlord and the property to other estate agents for distribution.

If the agent transfers the property to another estate agent for distribution, the agent must ensure that the distribution agent is in compliance with the advertising requirements in the Estate Agents General Regulations.

8. Advertising

The owner authorizes the agent to issue an advertisement about the property.

If the answer to the above question is "Agree", the advertising promotion fee will be borne by the agent, unless otherwise specified in this Agreement.

9. The agent must disclose the rights representative. The person signing this agreement by the agent is hereby disclosing his or his specified relatives, or any of his nominees, or any nominee of his specified relatives, or any employee/major shareholder/partner of the agent or agent/ The director has a monetary or other beneficial interest in the property

The person signing this Agreement on behalf of the Agent shall, as soon as practicable, disclose in writing to the Landlord any interest referred to in the above paragraph arising during the validity period.

10. The owner confirms that the owner has confirmed that he has

Obtain information about the property for the owner;

Arrange for tenants to inspect the property;

Negotiate and submit all offers for the property to the owner; and

Assist owners and tenants to enter into binding leases.

Schedule 2 Commission payable by the landlord

1. Subject to section 2 of this Schedule, if the owner enters into a binding lease with the tenant through the agent and the tenant during the period of validity, the owner must:

A commission of _________% of the amount of $_________/transaction rent is paid to the agent as an agent's commission.

2. Subject to section 3 of this Schedule, the owner is not obliged to pay any commission to the agent if the binding lease fails to commence on time due to the owner's mistake. In this case, if the owner has paid the commission, the agent shall, as soon as practicable, return the commission together with interest/not with interest to the owner.

3. If the landlord and the tenant jointly cancel the binding lease without a lease-based provision, the owner must pay the commission to the agent when the lease is cancelled.

4. If the agent cooperates with other estate agents for the rental of the property, the owner is not required to pay any commission to the estate agent.

Schedule 3 Interests in the property

Details of the monetary or other beneficial interest in the property in accordance with section 9 of this Agreement are as follows

Refers to the deletion of those who do not apply. All deletions must be shorted.

Enter the name of the estate agent business entity in section 1 of this Agreement.

Exclusive Agent - means that the agent is the only real estate agent acting for the owner. The agent has the right to recover the commission specified in section 1 of the Second Schedule from the owner if the owner enters into a binding lease for the property with another tenant during the period of validity.

Unilateral agent - means that the agent only acts for the owner.

Bilateral agent - means that the agent acts both as an owner and as a tenant of the property.

It is possible to represent the agents of both parties - the agent acts only for the owners, but may also act for the tenants of the property later.

The amount or rate of commission may be negotiated between the owner and the agent.

Identify relatives - refer to spouses, parents, children, brothers or sisters.

Major shareholder - means a person who has the right to exercise 10% or more of the voting rights or control the exercise of 10% or more of the voting rights at the general meeting of the agent.

Have monetary or other beneficial benefits, including

Being a member of a company or any other group that has a monetary or other beneficial interest in the property;

a partnership with, or employed by, a person who has a monetary or other beneficial interest in the property; or

A party that belongs to any arrangement or agreement relating to the property.
