In accordance with the "Contract Law of the People's Republic of China" and other relevant laws and regulations, in order to clarify the rights and obligations of both parties to the public rental housing, protect the legitimate rights and interests of both parties, the following contract is signed by both parties:
Article 1 Party A agrees to lease the housing of the district as a public rental housing to Party B for a building area of square meters.
Article 2 The house is limited to the residence of Party B or cohabitation with its family members, and Party B has no right to dispose of the house without authorization.
Article 3 The term of the house lease shall be from the date of the filing of the municipal housing security department to the date of the year.
Article 4 The rent shall be paid once every six months. Party B shall pay Party A the rent for the next 6 months before the end of every 6 months. If Party B fails to pay the rent late, Party A shall add a late fee of 2% of the total rent due from the date of overdue.
The house rent standard is RMB per square meter of floor space per month. If the government adjusts the rent during the contract period, it will still be executed according to the rent standard stipulated in this contract.
The total rent for a house is yuan, and the monthly amount is yuan. On the date of signing the contract, Party B shall pay Party A the rent for the rented house owner or the owner of the property for 6 months; the remaining rent shall be paid by Party B to Party owner or property owner once before the end of 6 months. . If Party B rents a house that belongs to the security department to rent social individual housing, and Party B pays the rent to the property owner or the property owner according to the market rent, Party B shall enjoy the preferential rent of the public rental housing that the protection object should enjoy. After every 6 months, it will be returned to the security target by the district-level housing security management department.
Article 5 During the lease period, the heating and property fees of the house shall be borne by the property owner; the water, electricity, gas and cable television charges shall be borne by Party B.
Article 6 If Party B defaults on rent and water, electricity, gas, cable TV, telephone, broadband, etc., Party A may notify its unit to directly deduct from its salary income or public rental housing rental concessions.
Article 7 When signing this contract, Party B shall pay the deposit to the owner of the house in accordance with the monthly rent standard for signing the contract, which is _____ yuan.
Article 8 Before signing this contract, Party B shall jointly verify the house and its ancillary equipment with the property owner and fill out the “List of Checkpoints for the Attachment of Facilities and Equipment”. Party B shall protect and reasonably use the house and its ancillary facilities and equipment, and shall not arbitrarily change the use of the house, and shall not sublet or lend it, and shall not arbitrarily decorate it, and shall not arbitrarily dismantle and expand it. If Party B improperly uses or artificially damages the house and its ancillary facilities, it shall repair or compensate for the loss as it is.
Article 9 The property owner shall, in order to protect the normal use of Party B, implement maintenance and repair of the house, and Party B shall provide support and cooperation for the maintenance and repair of the house. During the lease period, due to damage to the house and its ancillary facilities and equipment, the Party shall take appropriate measures to prevent damage and expand, and immediately notify the property owner to repair. After receiving the notice, the property owner should go to the door to check and implement the repair.
Article 10 The property owner shall ensure that the fire safety facilities of the house comply with the safety standards stipulated by relevant laws, regulations and policies, and urge the property service units to do a good job in fire safety in public areas. Party B promises not to store inflammable and explosive materials in the house or in public areas, and not to change the water supply, heating pipes, power supply lines, or install electrical equipment in violation of regulations.
Article 11 Both Party A and Party B shall actively cooperate with the housing security department or its client to inspect the use of the house and the relevant information of the household.
Article 12 When Party B has one of the following acts, Party A may notify Party B in writing to terminate this contract.
1. Fraudulently obtaining public rental housing security by means of false reporting, concealment or forgery;
2. Due to changes in employment and real estate conditions, it is no longer eligible for public rental housing applications to be overdue;
3. Transfer, sublease, lend, engage in other business activities, or use it for illegal activities;
4. Unauthorized renovation or alteration of the structure of the house;
5. The accumulated rent has not been paid for more than 3 months;
6, no valid reasons, not lived for more than 3 months;
7. Other acts that violate the rules of the house and the circumstances are serious.
Article 13 After the termination or dissolution of this contract, Party B shall vacate the house within 7 days, and notify Party A or the property owner to inspect the house and handle the handover of water, electricity, gas, cable TV, telephone, broadband charges, etc. If the house and its ancillary facilities and equipment are damaged or lost during the inspection, Party B shall be responsible for compensation.
Article 14 If Party B violates the relevant laws and regulations and the relevant provisions of this contract, and does not vacate the house, Party A or the property owner shall have the right to unilaterally withdraw the rented house. Party B's items in the house, Party A or the property owner of the house may be counted and vacated under the supervision of the notary office, and the expenses incurred shall be borne by Party B.
Article 15 After the expiration of this contract, if Party B needs to renew the lease, Party B shall, within one month before the expiration of the term of this contract, go through the procedures for renewal of the lease in accordance with relevant regulations, and notify Party A in writing.
Article 16 Party A and Party B shall enjoy rights and assume obligations in accordance with this contract. In case of adjustments to the laws and regulations of the state or local governments, the part of this contract that has conflicts with it shall be subject to the adjusted laws and regulations.
Article 17 Other agreed matters:
1. During the lease period, if the contract cannot be fulfilled due to force majeure, this contract will be automatically terminated, and both parties will not be responsible for each other.
2. During the lease contract period, Party B shall withdraw from the public rental housing security within three months due to the improvement of economic conditions and the increase of income level and not meeting the conditions for the enjoyment of public rental housing, or the purchase, donation or inheritance of other housing.
3. When Party B voluntarily withdraws from the public rental housing during the lease period, Party B may apply to terminate the contract in advance, and both parties shall settle the relevant fees in accordance with relevant regulations.
4. Other:
Article 18 In the period of performance of the agreement, if one party breaches the contract, in addition to the normal settlement, the other party shall be compensated according to the three-month rent amount.
Article 19 The disputes arising during the performance of this contract shall be settled by the parties to Party A and Party B through negotiation; the relevant departments may also mediate; if the negotiation or mediation fails, the following methods shall be resolved:
Submitted to the Arbitration Commission for arbitration;
Prosecuted to the people's court according to law.
Article 20 This contract shall be made in triplicate. Each Party A and Party B and the Housing Security Competent Authority shall each hold one copy and shall have the same effect. This contract is effective as of the date of signing by both parties.
