Third, the rights and obligations of the lessor

1. In the event of any of the following circumstances, the lessor has the right to take back the rented vehicle anytime and anywhere, and the amount already collected is refunded after the calculation of all losses.

The lessee uses the rented vehicle to engage in illegal and criminal activities.

The lessee transfers, subleases, sells, mortgages, and pledges the leased vehicles.

Engage in other activities that damage the legitimate rights and interests of the lessor's vehicles.

The vehicle is arrears after the end of the vehicle rental period without the written permission of the lessor.

If the economic loss is caused to the lessor under the above circumstances, the lessee shall make corresponding compensation.

2. Does not assume the third party liability caused by the rental vehicle during the lease period.

3. Other rights that the leasing party should have in accordance with the provisions of laws and regulations.

4. Provide vehicles with good technical status and complete fees according to the contract.

5. Monitor the use of the vehicle and the customer's reputation during the lease period.

4. The rights and obligations of the lessee

1. Ownership of the leased vehicle at the lease term specified in the lease contract.

2. The compensation for existing damages before the lease of the leased vehicle shall not be liable for compensation or maintenance.

3. Pay the full amount of the mortgage on the date of signing the lease contract and pay the rent in full in cash; if you use the bank credit card, you will be responsible for the handling fee that should be paid to the bank.

4. Self-support the fuel cost of the vehicles rented during the lease period.

5. Obey the obligations of the Notice for Car Renters.

6. During the lease period, all laws and regulations of the state shall be strictly observed, and all liabilities and economic losses arising from acts such as violations of laws and regulations may be assumed.

7. The lessee must bear other economic losses due to the behavior of the lessee.

8. Assist the lessor in handling the loss and claim of the vehicle insurance accident during the lease term.

V. Mortgage clause

1. The lessee shall deliver the corresponding mortgage to the lessor in full and on one lump sum on the date of signing of the lease contract in accordance with the provisions of the leasing party.

2. The lessor shall return the remaining deposit to the lessee in addition to the fee deducted in accordance with the provisions of this contract and the attached files after the lease contract expires or the parties agree to terminate the contract.

3. The lessee cannot substitute the deposit for rent.

4. If the driver is provided by the lessor, the lessee does not have to pay the deposit.

Six, insurance clauses

1. The lessor has provided corresponding insurance for the rental vehicle. For details, please refer to the “Car Rental Registration Form”.

2. The lessee shall notify the lessor within 24 hours of the occurrence of the traffic accident. The lessor will arrive at its designated repair shop at the insured vehicle, the lessee shall provide valid all insurance certification procedures, and the chartered vehicle shall comply with the “Car Rental Registration Form”. When the vehicle specified by the lessor for insurance claims is set, the calculation of the rental fee is stopped. If the lessee loses, scraps or otherwise loses the vehicle while the vehicle is being rented, the lessee shall bear 40% of the vehicle rent and the insurance deductible portion from the date of loss of the vehicle until the lessor obtains the indemnity of the insurance company.

3. All losses and related expenses of the insurance company's refusal and exemption due to the reasons of the lessee shall be borne by the lessee.

4. In the event of an insurance accident, the lessee shall deliver the accelerated depreciation charge of the vehicle and the deductible of the insurance company. The accelerated depreciation charge is equivalent to 30% of the total maintenance cost of the accident. If the lessee cannot obtain the relevant procedures necessary for the insurance company to settle the claim, the lessee will bear all the maintenance costs and accelerate the depreciation, and bear the responsibility for the insurance event.

VII. Liability for breach of contract In addition to major policy changes or force majeure, if any party fails to perform the contract in violation of the provisions of the contract, in addition to compensating for the corresponding economic losses, it shall also pay the other party a contract and an unsuccessful part of the subsidiary file. % of liquidated damages. The lessee shall return the leased vehicle in time according to the time of return of the vehicle signed by the two parties. If the lease is overdue for one day, in addition to continuing to collect the rent, an additional penalty of 20% of the daily rent shall be paid. Each day in advance is refunded, and the rent for that day is refunded after a 20% liquidated damages on the delivery date.

The economic losses referred to in this contract include rent loss, and the compensation standard for rent loss is calculated according to the rent standard listed in the Car Rental Registration Form.

8. Change and Cancellation of the Contract The modification and dissolution of this contract must be signed by the parties to the lease to be effective.

IX. Settlement of disputes All disputes concerning this contract shall first be settled through friendly negotiation. If the negotiation fails, any party may apply to the arbitration committee of Haikou City Administration for Industry and Commerce for jurisdiction or apply for litigation by the People's Court of Meilan District, Haikou City. solve.

X. Contracts and ancillary files “Notes for Automobile Renters”, “Automobile Lease Registration Form”, “Rental Vehicle Inspection Report”, “Car Rental Statement” and “Supplemental Agreement” are subsidiary files of this contract, and this contract has The same legal effect.

XI. This contract shall be in duplicate after the signature and seal of both parties to the lease, and shall be executed by the lessor and the lessee.
