This "Hosting Contract" is the legal contract between Party A and Party B regarding the host in _________. Once this contract is signed and sealed, it is effective, indicating that both parties accept the constraints of this Agreement:

1. Party A’s obligations and rights

Party A is responsible for the software system of the host. All software, programs, passwords, technology, intellectual property rights, license patents and other property rights used by Party A shall be owned by Party A, and the responsibility arising therefrom shall be borne by Party A.

Party A guarantees that the information published on the hosted or leased host does not violate the relevant laws and regulations of the People's Republic of China. It is forbidden to spread propaganda on the host that violates public morality such as obscenity, violence, and law.

Party A's host must be authenticated before it can access the internet. After access, it is guaranteed that it will not affect other hosts.

Party A shall pay the relevant fees on time.

2. Party B’s obligations and rights

Party B provides Party A with the necessary rack, network environment and network resources for accessing the internet.

Party B guarantees that Party A will use the host to access the internet and run stably, and ensure that the data on Party A's site is not lost due to network failure.

Party B guarantees the safety of the equipment of Party A during the hosting or lease period.

Party B assigns the required ip address to Party A.

Party B will make the server network settings free of charge. If Party A needs Party B to install and debug other software and hardware systems, Party B will charge the corresponding commissioning fee.

Party B reserves the right to terminate the operation of Party A's site due to Party A's activities prohibited by this contract.

Third, the term and tariff

V. Term of the contract

The validity period of this contract is within the period of hosting or lease, which takes effect from the date of signing. Whether the contract is renewed when the contract term arrives is negotiated by both parties.

6. Termination of contract and liability for breach of contract

If Party A defaults, Party B has the right to terminate the operation of the host hosted or leased by Party A, and Party A shall be responsible for the losses caused.

If Party A fails to pay the renewal amount on time, the contract will be suspended after Party A's previous payment period expires. Party B will close Party A's server at that time.

If Party A needs other services of Party B during or after the contract, both parties must sign a separate contract.

Party B is in the server configuration, maintenance sometimes needs to interrupt the service for a short time, or due to the accidental blocking of the channel on the internet and the force majeure factors such as the adjustment of the line by the telecommunications bureau and the interruption of the external power supply, the access speed of the party A is degraded or temporarily unavailable. Access is a normal situation and is not a breach of contract by Party B.

Because Party A's host software system, virus infection, hardware failure, causing Party A's host to not work properly, Party B does not assume any responsibility, Party A assumes responsibility.

Seven, dispute resolution

If there is a dispute between the two parties during the execution of the contract, the two parties shall resolve it through friendly negotiation.

Eight, force majeure

Due to earthquakes, fires and other natural disasters, wars, strikes, power outages, government actions, accidental obstruction of access on the Internet, adjustment of the telecommunications sector, etc., the parties are unable to perform this contractual obligation, and both parties notify each other in writing, this contract It will be suspended.

IX. Description of managed equipment

Before the host is in use, both parties must check the natural conditions of the server hardware in detail. Party A must fill in the server hosting application form. After Party B has checked the natural conditions of the equipment, Party B will go through the formalities and sign this contract.

During the contract period, Party B shall maintain the servos of Party A in accordance with the basic maintenance standards of hardware devices to ensure that the hardware of the equipment is safe under normal operating conditions and is not damaged. If an abnormal state is found during the operation of the equipment during the contract period, Party B shall take necessary maintenance measures and notify Party A in a timely manner. For the hardware damage caused by the abnormal factors during the contract period, Party B shall negotiate with Party A according to the specific circumstances and assume the necessary responsibilities.

X. Supplementary rules

If there is any outstanding matter in this contract, the two parties will resolve it through negotiation. This contract is made in triplicate. Party A holds one copy and Party B holds two copies. After signing and stamping, it will take effect. The three contracts have the same effect.
