Article 2 Lease term

Article 4 Lease method and ownership
4.1. Lease method: The lease of this equipment is provided by the lessor with the operator. Responsible for the operation and maintenance of the equipment.
4.2. Ownership of the leased equipment: The ownership of the leased equipment listed in the contract's subsidiary file belongs to the lessor. The lessee has the right to use the leased machinery only during the lease period and has no ownership of the equipment.
4.3. Without the consent of the lessor, the lessee may not arbitrarily add or reduce parts on the equipment, nor may it mortgage the equipment for any reason, otherwise the consequences will be borne by the lessee.
Article 5 The signing time of the rental price and the signing of the rental fee
5.1. Rental price: The equipment is charged at a monthly fee of _________ yuan. The future usage time is calculated based on 30 calendar days. The last use time is less than the whole month, and the monthly fee is _________ yuan per calendar day. Rental fees.
5.2. Rental billing start and end time

5.3. The operation time and the rental fee are signed: the date when the machine arrives at the construction site is the lessor. If the power generation cannot be used for billing, the lessee must apply for the arrival date. After the rental billing time begins, the two parties sign a mechanical rental fee every month. 5.4. Machinery entry and exit fees: The mechanical entry and exit transportation is handled by the lessor, and the lessee assists the loading and unloading. The entry and exit fees for machinery are all borne by the lessee.
Article 6 Payment method

Article 7 Obligations and Responsibilities of Both Parties
7.1. The obligations and responsibilities of the lessor
7.1.1. Work closely with the construction of the lessee to meet the construction requirements of the lessee. Obey the construction arrangements of the tenant construction workers, but have the right to refuse the illegal conduct of the lessee.
7.1.2. Responsible for equipment operation, maintenance personnel, responsible for equipment operation, daily maintenance and fault handling, to ensure that the mechanical technology is in good condition. If a single continuous shutdown is caused by a fault for more than three days, the overtime will not be charged.
7.1.3. Responsible for the operator's salary and equipment repair parts
7.1.4. Work with the lessee to handle the signing of the rental of machinery and equipment.
7.2. Lessee's obligations and responsibilities
7.2.1. Responsible for the safety of renting machinery and operating drivers during work, it is strictly forbidden to violate the regulations, such as mechanization and personnel damage caused by illegal command, the lessee bears all responsibility losses.
7.2.2. Free boarding for the driver’s operation of the driver. Bear the driver's overtime and construction subsidies.
7.2.3. Responsible for the signing of the rental equipment and the signing of the monthly rental fee, responsible for the timely payment of the rental fee.
7.2.4. Responsible for equipment protection and guard during the rental period to ensure the safety of the generator.
7.2.5. Provide qualified fuel and lubricants. Because the fuel is unqualified, the driver has the right to not refuel, and the loss caused by the loss is borne by the lessee.
7.2.6. During the lease period, if the lessor purchases spare parts and materials, the lessee shall provide convenient transportation, and the required funds shall be levied on the lessee and deducted from the rental fee.
7.2.7. Responsible for the rental of machinery into and out of the freight, responsible for transportation safety, bear transportation costs and insurance.
Article 8 Damage and loss of rental machinery
8.1. The lessee bears the risk of damage and loss of the lessee's liability for the rental machinery that occurs during the lease term. If the contract cannot be fulfilled due to force majeure or the loss is caused, the actual situation of both parties shall be settled through negotiation.
8.2. In the event of damage or loss of the rental machinery, the lessee shall immediately notify the lessor that the lessor has the right to choose one of the following methods, and the lessee shall be responsible for handling and paying all expenses.
8.2.1. Restore or repair the rental machine to a state where it can be used normally.
8.2.2. Replace the same model as the rental machine, and the performance parts or accessories make it work properly.
8.2.3. When the damage to the leased machinery is lost to the extent that it cannot be repaired, the lessee shall compensate the lessor for the amount of damages stipulated in the attached file of the contract.
Article 9 Liability for breach of contract
9.1. When the lessee delays the payment of the equipment entry fee or delays the prepaid mechanical rental fee, the lessor's equipment will delay the entry stop.
9.2. Without the written consent of the other party, neither party may change or terminate the contract in the middle. Any party who violates this contract shall pay the other party a penalty of 20% of the total rent of the contract.
9.3. If the lessee fails to pay the rental fee or violates any of the terms of this contract, the lessor has the right to take the following measures:
9.3.1. The lessee is required to pay the rent and other fees in a timely manner and ask the lessee to compensate the lessor for the loss.
9.3.2. The contract is terminated, the leased equipment is recovered, and the lessee is required to compensate the lessor for all losses.
Article 10 Affiliated files of this contract The subsidiary files of this contract are an integral part of this contract and have the same legal effect as the body of this contract. The sub-files of this contract include the lease contract attachment file 1, the leased machinery delivery and the arrival receipt receipt, and the mechanical lease fee signed by both parties. And supplementary provisions made by both parties through consultation.
Article 11 Dispute Resolution If there is a dispute in this contract, both parties shall settle the dispute in time. If the negotiation fails, either party may request the competent business authority to mediate or bring a suit in the people's court.
Article 12 This contract shall be signed and sealed, and the contract shall be in four copies, each party holding two copies.
