County Safety Production Supervision Administration 2005 special law enforcement self-examination report

According to the No. 76 file of the New Deal Office [2005] and the relevant archives requirements of the provinces and municipalities, since June 10, the Bureau has carried out self-inspection of administrative law enforcement self-inspection in light of the actual situation of the unit. The inspection work report is as follows:
I. Basic Situation of Administrative Law Enforcement Since the beginning of this year, the safety production supervision and supervision has been conducted. A total of 201 production safety supervision and supervision have been carried out on 100 production and operation units or sites. The supervision and inspection coverage rate is 25.25%, and the supervision and inspection review rate is 101.00. %, found 342 security risks, issued 169 major administrative law enforcement documents, including 92 "reforms", 17 on-site inspection records, 25 reconsideration opinions, 18 administrative punishment decisions, administrative punishment decisions 8 copies of the book, 8 copies of administrative penalties, and 1 copy of mandatory measures. Revising the hidden dangers of existing accidents, ordered 92 enterprises to rectify within a time limit, ordered 3 enterprises to suspend production and suspend business for rectification, ordered a dangerous operation site to immediately stop operations and evacuate all personnel and equipment, and implemented 214 rectification of accident hazards. It was 62.57%; a total of 12 fatal accidents were investigated and 2 cases were closed, and the accident settlement rate was 16.67%. In the supervision and supervision and accident investigation and handling, a total of 49 administrative penalties were imposed on various production and business units and individuals, and the total amount of administrative penalty fines was 205,600 yuan.
Safety Production Administrative Licensing Since the beginning of this year, a total of 15 non-coal mines “safe production licenses” have been reviewed. Among them, 6 non-coal mines have obtained the “Safe Production License” issued by the provinces and municipalities, and 9 non-coal mines. The mountain is in the process of bidding. A total of 15 hazardous chemicals production and operation enterprises "safe production license" or "business license" for the initial examination, of which four hazardous chemicals production enterprises have obtained the "safe production license", 11 hazardous chemicals The product management company is in the process of bidding.
Second, the main practice of administrative law enforcement work since this year is to ensure the quality of administrative law enforcement of the bureau, and conscientiously implement the "Administrative Licensing Law of the People's Republic of China", the "Administrative Punishment Law of the People's Republic of China" and the "Safety Production Law of the People's Republic of China" The "Regulations on the Formulation and Filing of Regulatory Archives of the Administrative Organs of Yunnan Province" and other laws and regulations, the Office has mainly strengthened the following aspects of work.
First, in order to comprehensively promote administration according to law, standardize administrative law enforcement, strengthen supervision of administrative law enforcement, and implement law enforcement responsibilities, according to the Notice of the Yunnan Provincial People's Government on Implementing the Administrative Law Enforcement Responsibility System in the Province, and the Yuxi Municipal People's Government on the Whole City The Notice on Implementing the System of Administrative Law Enforcement Responsibility and the Notice of the Xinping County People's Government on Implementing the System of Administrative Law Enforcement Responsibility in the County and Relevant Laws, Regulations and Regulations, Further Perfecting the Administrative Law Enforcement of the Xinping County Safety Production Supervision Administration The Implementation Measures of the Responsibility System and the Administrative Law Enforcement Responsibility of the Xinping County Safety Production Supervision Administration, and the Secretary and the two administrative law enforcement departments signed the administrative law enforcement responsibility letter, which fulfilled the law enforcement duties, the licensing rights, and clear law enforcement responsibilities. It has embarked on the track of institutionalized management and ensured the effective implementation of various laws and regulations such as the "Safe Production Law of the People's Republic of China".
The second is to further increase the training of the overall staff and strive to improve the level of law enforcement. In accordance with the needs of work safety law enforcement for safe production, the bureau has incorporated the laws and regulations on safe production into the "Four-Five" law. The main contents are "Administrative Licensing Law of the People's Republic of China", "Administrative Punishment Law of the People's Republic of China" and "People's Republic of China". "Safe Production Law", "Ministry of Mines Safety Law of the People's Republic of China", "Administrative Punishment Measures for Safe Production Violations", "Regulations on Safe Production License" and other laws and regulations. In the study, we insist on four combinations, namely, the combination of collective learning and self-study; the combination of learning laws and regulations and learning business knowledge; the combination of legal education and moral education; and the combination of collective discussion and center speech. At the same time, actively select relevant personnel to participate in various administrative law enforcement training classes held by the province, city and county, strive to achieve the purpose of learning, practice internal strength, strengthen quality, continuously strengthen team building, improve law enforcement level, and receive good results. Administration has laid a good foundation. At present, all staff members have obtained administrative law enforcement certificates.
Third, according to the requirements of the “Implementation Plan for the Work of Cleanup and Standardization of Administrative Examination and Approval Items in Xinping County”, the relevant personnel were organized to further clean up the administrative licensing project. A total of 12 administrative licensing projects were cleared out, and the number of administrative licensing projects was determined. Examine the power and arbitrarily set up an administrative licensing project.
The fourth is to comprehensively clean up the normative files. After cleaning up, since 2000, the bureau has not issued a normative file.
The fifth is to adhere to the administration according to law and strictly regulate the safe production behavior of production and business units. In the process of law enforcement of production safety, the Office has always adhered to the "Safety Law of the People's Republic of China" and other laws and regulations, insisting on the production of law enforcement documents, law enforcement shall not be less than 2 persons, and the hidden dangers of the accidents discovered shall be rectified within a limited time. Or the rectification is not thorough, and economic punishment is imposed. If it still refuses to rectify, it will be ordered to suspend production and suspend business for rectification until the program of the county people's government is closed, and the safe production behavior of the production and operation units is strictly regulated.
III. Self-inspection and self-inspection From the self-inspection and self-inspection situation, since the bureau insists on administration according to law and standardizes specific law enforcement actions, the administrative law enforcement personnel can basically perform the duties of safety production administration, handle all kinds of administrative cases according to law, and enforce the law. Legitimate, applicable laws, regulations, and rules are correct, legal procedures are complete, and law enforcement actions are not found for law enforcement officials to violate the law and discipline, to exceed legal authority, and to violate legal procedures. There have been four obvious improvements in the law of safety production law enforcement: the basic work of the safety production legal system has improved significantly, and it can basically adapt to the development needs of the current safe production situation; the law enforcement personnel's legal concept is obviously improved, and the law is based on the law. The problems are basically eliminated; the weakening of the safety production supervision and management has been significantly improved, and the law has to be followed, the law enforcement must be strict; the chaotic situation of the safety production management has improved significantly, effectively preventing the casualties.
Fourth, the existing problems The overall quality of law enforcement personnel needs to be further improved, the law enforcement procedures are not in place, and the phenomenon of non-standard law enforcement documents is still in varying degrees.
It is difficult to enforce administrative law enforcement for safe production, and it is difficult to enforce penalties for enterprises with financial difficulties. The law enforcement environment needs further optimization.
V. The next step is to fully implement the administrative law enforcement responsibility system as the core, adhere to the "first-in-command" general responsibility, sign a letter of responsibility with the department, include the administrative law enforcement responsibility system in the annual comprehensive assessment target, and thoroughly implement the administrative law enforcement responsibility.
Strengthen the construction of administrative law enforcement teams, and take this as the top priority of law enforcement work, and always work hard. Intensify the work of the "Four-Five" law-enforcement work, encourage law enforcement officials to improve their cultural quality, implement relevant funds, strengthen law enforcement business training, and resolve the phenomenon of heavy entities and light programs in administrative law enforcement. When a person’s punishment is imposed, the content of the right notification is incomplete, the awareness of the collection of evidence in the case is not strong, the production of legal documents is incomplete, and the issue is not standardized.
Increase the "hard" capital investment and equip law enforcement personnel with the necessary tools.
Strengthen the basic work of law enforcement, establish a system of account books, and harmonize the format of law enforcement documents and file file management.
In 2005, under the guidance of the competent department of higher authorities, the administrative law enforcement work of the Bureau has achieved some results, but there is still a certain gap with the requirements of laws and regulations. We will take the current educational activities to maintain the advanced nature of party members as a wedge, take the "Five-Five" Law as a breakthrough, take safety production laws and regulations as the criterion, and exercise according to law, and make every effort to promote the stability and improvement of the county's production safety. Maintain the fundamental interests of the broad masses of the people of the county.
